In addition to general rules, the Model Building Regulations (MBO) also contain regulations on the land and its development, regulations on structural installations – e.g. general requirements for the construction design, the fire behaviour of building materials and components, rescue routes, openings, reinforcements, technical building equipment, construction products and types of construction – as well as regulations on those involved in the construction, the construction supervisory authorities and procedures for administrative offences, legal provisions as well as transitional and final regulations.

These are amendments or additions to existing regulations.
9. The Model Building Regulations establish a framework for the building regulations legislation in the 16 federal states. The current additions are made in the text of the MBO notified in procedure 2022/0720/D, the rest of which remains unchanged.
Part of the amendments are intended to implement the EU Machinery Directive (2006/42/EC) with regard to building regulations law. Amendment to Section 1 clarifies that wind turbines and their parts which are subject to the Directive do not, in principle, fall within the scope of the MBO, with the exception of those provisions of the MBO which are not covered by the Directive. A change concerning the stability of the foundations of wind turbines with a height of more than 10 m shall be made in the building technical certificates (Section 66). Due to the replacement of the Directive by Regulation 2023/1230 as of 14 January 2027, a transitional regime (Section 87) is provided for.
In order to implement the EU Directive 2018/2001 (RED II), the simplified building permit procedure (Section 63) shall also be open for installations covered by this Directive, in particular wind turbines with a height of more than 30 m. In addition, the permit exemption (Section 62) is introduced for the so-called repowering.
Furthermore, the amendments concern the privileging of antenna systems under building regulations, in particular with regard to the clearances (Section 6) and the process exemptions (Section 61). With regard to the building technology certificates (Section 66), there is a regulation for antennas with a mast height of more than 10 m.
With regard to fire protection, the purpose of the amendment is to facilitate the requirements for fire walls for buildings that move to building class 4 as a result of retrofitting roofs (Section 30(5)) and to adapt to the current state of the art of gas absorption heat pumps that can be operated without facilities for the discharge of exhaust gases (Section 42(3)).
In order to strengthen the use of the already available materials, a new provision is created in Section 48, according to which certain provisions concerning the reuse of residence spaces in legally existing buildings in residential areas shall not apply on existing components, in particular Sections 6 (Clearances), 27 (Carrying walls, supports), 28 (External walls), 30 (Fire walls), 31 (Ceilings) and 32 (Roofs).
The attic expansion for residential purposes is also included in the scope of the permit exemption procedure (Section 62(1)(2)). This means that the permit exemption is also applicable outside development planning areas and the construction can start no later than one month after submission of the documentation, unless the municipality has any concerns.
The derogation provision in Section 67 is supplemented by amendments to the target regulation and three rule examples, including the so-called experimental clause.
With the creation of a new paragraph 1a in Section 72, the permit fiction for projects under the simplified building permit procedure is provided for. Accordingly, the building permit applied for is deemed to be approved for the construction or modification of a building subject to the simplified permit procedure within three months of the start of the decision-making period.
The catalogue of mobile structures (Section 76), for which no execution permit is required, is restructured and supplemented (para 2). The rules on the competent authority to notify the change of residence or commercial establishment will be adapted to the rules of jurisdiction changed in many countries (para 6). The provisions relating to the display of the planned establishment will be specified with regard to the date of the notification; in future, the waiver of acceptance for use is to be documented (para 7).
The notification is made on behalf of the 16 federal states of the Federal Republic of Germany.
