5. Order amending the Order of 5 September 2003 laying down the compulsory implementation of standards
6. The following fertilising materials: Organic fertilisers, fertilising materials with an agronomic additive; basic mineral soil conditioners.

8. The purpose of this Interministerial Order is to make mandatory an additive to a standard on organic fertilisers, a second additive to a standard on basic mineral soil conditioners, and a third additive on fertilising materials with an agronomic additive.
This measure is an exemption from marketing authorisation, referred to in Article L. 255-2 of the Rural and Maritime Fisheries Code and provided for in Article L. 255-5(1) thereof.
Consequently, the purpose of this draft is to make mandatory:
• Amendment A1 to the existing standard NF U42-001-2 on organic fertilisers: This amendment supplements the 2020 general standard by amending paragraph 7.1.1.3 to specify for mandatory marking that fertilisers exclusively containing animal by-products of the manure type, neither processed under the European rules on animal by-products nor hygienised under the Order of 9 April 2018, must indicate ‘Unprocessed livestock manure and without guarantee of hygiene under the animal by-product rules’.
• Amendment A1 to the existing standard NF U 44-001 on basic mineral soil conditioners: As Regulation (EC) No 2003/2003 has been repealed and replaced by Regulation (EU) No 2019/1009, this amendment A1 aims to update the approved standard NF U 44-001: 2017 which refers to this repealed Regulation. Paragraph 5 is amended by deleting the footnote to the tables in 5.1 to 5.6 and referring to the repealed regulation.
• Amendment A1 to the existing standard NF U 44-204 on fertilising materials with an agronomic additive: It complements NF U 44-204 (2015), which applies to fertilising materials with agronomic additives.
- It amends paragraph 1, ‘scope’, by specifying that authorised additives must be granted a marketing authorisation with the designation ‘agronomic additive’, and authorises the combination of additives.
- It updates the normative references in paragraph 2 and amends the terms and definitions in paragraph 3 by incorporating the revised definitions from the newly revised standards.
- It specifies the classification of fertilising materials by amending Article 4 and clarifies the names, in particular by incorporating the reference to Regulation (EU) 2019/1009 (paragraph 5) and adds a name (No 4) allowing the combination of additives: ... with a combination of agronomic additives (list of agronomic additives (cf. 3.7) present in the mixture)
- The specifications for trace element content shall be specified by reference to the standard under which the fertilising material formulated with the additive is placed on the market (paragraph 6)
- The marking (paragraph 7) is amended to correspond to the modifications of the previous paragraphs.
9. These additives to existing standards reinforce those standards, which are used in particular by producers, users, and official control bodies. They are not intended to establish a selection meeting commercial quality criteria; they only propose to define and characterise each type of fertiliser to facilitate its distinction and choice, unambiguously for the user.
For public health reasons, the standards for fertilising materials and growing media are made mandatory. Amendment A1 to standard NF U 42-001-2, Amendment A1 to standard NF U 44-001, and Amendment A1 to standard NF U 44-204 should therefore be made mandatory.
