5. Decree tightening the regulation of bladed weapons
6. The draft text aims to classify certain bladed weapons as Category A1 – that is, weapons prohibited for acquisition and possession – and to introduce a requirement to display a notice warning that the sale of weapons to minors is prohibited.

8. This text classifies certain edged weapons as category A1: knives and knuckle-dusters as defined in point 6. This classification entails a prohibition on the acquisition and possession of these weapons, and makes their sale subject to the issue of a ministerial authorisation known as a manufacturing, trading and intermediation authorisation.
The sale of weapons is prohibited to minors in France. Weapons dealers are already obliged to display a reminder of this ban on their premises. The aim of the Decree is to extend this warning obligation to websites offering weapons for sale, whether they are professional websites or private individuals. A provision adapts this obligation to online sales platforms, which must adapt their technical features so that sellers can display this message on the presentation of their products.
9. Acts of injury against individuals, and in particular minors, are increasing in France and require a response from the public authorities. The preservation of public safety therefore requires the adoption of a number of measures to better control the use of bladed weapons on our territory, and to improve prevention of access to these weapons by minors. Therefore, the draft decree pursues a twofold aim. Firstly, to prohibit, by means of a classification, certain bladed weapons with proven dangerousness and which have no material use or are not used in the context of authorised leisure activities. Secondly, to step up communication around the existing prohibition on the sale of weapons to minors. The increasing use of online commerce sites, and in particular matchmaking platforms, requires the adoption of measures specifically targeting them. It should be noted that this draft text has neither the purpose nor the effect of further limiting online commerce, but simply of making its actors accountable by requiring them to comply with existing legislation.
The text, which has been coordinated with the actors of the sectors concerned, thus appears balanced.

12. The proliferation of incidents, sometimes fatal, involving bladed weapons and minors requires a rapid response from the French authorities. The proposed measures are essential for the improvement of public security and the protection of minors: the knives which this text prohibits from acquisition and possession, and which will be subject to trade licences, are often prized by minors and serve no purpose but to intimidate, injure or kill. The reminder of the ban on the sale of weapons to minors, an old principle that has been perfectly integrated by professional arms dealers, seems necessary for sellers of edged weapons who do not all have an arms dealer's diploma. It was also necessary to clearly establish this obligation to advertise, which in itself does not constitute a restriction of the terms and conditions of sale, for online sales sites and intermediation platforms. Therefore, it is imperative that the text submitted enters into force as soon as possible, particularly in view of the fact that the beginning of the school year in September requires measures adopted and integrated by the various actors who will have to apply them (law enforcement forces in particular). Directive 2015-1535 states that the protection of public order in the face of a serious and unforeseeable situation, in particular where such protection concerns minors, constitutes justification for using the emergency procedure (the measures are intended to protect minors).
