6. Requirements for the accessibility of a building in order to ensure a level playing field for the use of buildings by the entire public.

8. The Bill will establish minimum requirements for the accessibility of buildings. Compared to the legislation currently in force, the purpose of the regulation is being amended to extend the current narrow view (unobstructed use of buildings by persons with disabilities) to the entire population, taking into account the principles of universal design. The scope will also be clarified and extended on the basis of the current list of purposes of use of the building, and minimum requirements for the accessibility of residential real estate will be added. In addition, exceptions are specified for cases where full application of the regulation is not possible (including architectural monuments, buildings with a small floor area or certain structures). The draft also updates the structure and content of the provisions in order to better cover all groups of the population affected by the legislation.

The regulation currently in force concerns buildings where services aimed at the general public are provided, but does not link the requirements with the intended use of the building, which in certain situations gives rise to interpretative and supervisory disputes. Similarly, the current regulation does not address the accessibility of housing. There are no exceptions for protected monuments or buildings with a small floor area, or certain types of structures where it is not possible to ensure all accessibility requirements. In connection with the extension of the focus to the accessibility of the entire population, all provisions had to be revised in order to take into account not only the specific needs of people with disabilities, but also, for example, the needs of children, the elderly and people with temporary special needs. It is therefore necessary to consolidate the requirements in a single and updated consolidated text.
The new regulation brings the regulation into line with the logic and modern standards of the Building Code, harmonises the definitions and scope of application, and lays down clearly verifiable minimum requirements. In order to ensure proportionality, clear exemptions and flexible solutions are provided for cases where, for objective reasons, full compliance is not feasible (such as monuments, small buildings), while ensuring access to the service in another way. The result will be a lower administrative burden, better guaranteed accessibility and a higher quality living environment for all users.
