With the amendment of the Order, maximum fees will be set, which define the level of service in the collection of packaging waste from the municipalities, which producers have to pay for. The maximum fees set a price per tonne for selected waste fractions collected through collection schemes within three municipal segments. Provisional maximum fees are stated, but these must be further qualified before the Order comes into force.
Adjustment Section 105
On 29 September 2025, a temporary solution was introduced in the Packaging Order with the aim of immediately reducing the costs of producers for municipal packaging waste management. This solution should work until a permanent measure is devised and implemented to reduce producers’ costs to municipalities. The long-term measure to reduce producers' costs to municipalities is the introduction of maximum fees, as described above. However, with the temporary solution, producers have paid too little to the municipalities for the period from 1 October 2025 to 1 July 2026. This must be adjusted. It is this adjustment that has been implemented in the Order. This amendment introduces a provision by which the Municipal Council shall, over a four-year period, collect a surcharge on the quarterly collections. The surcharge amounts to 20 per cent, plus market interest rate, of the fee charged by the Municipal Council on 1 October 2025, 1 January 2026 and 1 April 2026.
The density factor Sections 94, 97, 98, 99 and new Annex 16 Administrative fees for the Environmental Protection Agency and Danish Producer Responsibility shall be calculated in relation to the reported quantity in kilograms. In order to avoid heavy materials paying proportionally too much and light materials proportionally too little, weight compensation is applied for each material category. The weight equalisation between different packaging materials shall be carried out using a density factor table. The density factors have not yet been calculated, which is why they are not included in the consultation.
Compensation for commercial waste Sections 65-67 and 120
Under the current Packaging Order, a waste-producing company has the right to request payment from producers to cover the costs of collection, transport and treatment of commercial packaging waste, cf. Sections 65 and 66. The upcoming amendment will stipulate in the Order that the waste-producing company, by written authorisation, has the right to allow the waste collector to request payment on behalf of the waste-producing company. In addition, Section 3 specifies further content requirements for the request for payment, cf. Section 66.
Obligation to provide information under Section 26(3).
With the amendment to the Order, an obligation to provide information will be introduced for companies that may be subject to registration, cf. section 21 of the Packaging Order. These undertakings will thus be obliged, at the request of the Environmental Protection Agency, to provide the information necessary to enable the Danish Producer Responsibility to decide whether the undertaking is covered by the rules on extended producer responsibility and thus obliged to register in the producer register.
Update of distribution keys in Annex 8
In addition, Annex 8 to the Packaging Order with distribution keys for the share of packaging waste has been updated with distribution keys for three new groupings, human health and social work activities, agriculture and construction, respectively.
