The practical experience gained over the years, together with developments in the CPVO quality standard with which the examination offices accredited by it as the Spanish Plant Variety Office must comply — and which the latter also applies to centres accredited to conduct DUS tests for the variety registers falling within the remit of MAPA — make it advisable to update the requirements in order to strengthen the safeguards governing the conduct of DUS tests. This is achieved through this Order. The amendments to update these requirements affect the technical regulations for the registration of varieties set out in Annexes I, III, IV, V, VII, VIII, IX, X, XI, XII and XIII to the General Regulation on the Register of Commercial Varieties, approved by Royal Decree 170/2011 of 11 February 2011.
In short, this Order updates the aforementioned requirements of the Technical Regulations for the Registration of certain species or groups of species, such as spinach; cereals; maize and sorghum; forage crops, herbage plants, turf grasses and grain legumes; oil and fibre crops; vegetables; grapevines; stone and pome fruit trees; citrus fruit; strawberries; olive trees; and fig trees.

Article 33(2) of the aforementioned Regulation, approved by Royal Decree 170/2011 of 11 February 2011, provides that, with regard to distinctness, uniformity and stability, the conduct of official examinations for the acceptance of varieties shall comply with the conditions laid down in the Protocols for the examinations of distinctness, uniformity and stability, issued by the Administrative Council of the Community Plant Variety Office (CPVO), using all the varietal characteristics set out in those protocols. Article 33(3) provides that, were that Office has not established a protocol for conducting the identification test for a particular species, the current examination guidelines of the International Union for the Protection of New Varieties of Plants (UPOV) shall apply, using all the varietal characteristics marked with an asterisk as set out in those Guidelines.
In accordance with these criteria, the project incorporates the updates made by the CPVO and UPOV to the protocols for the following species included in the General Regulations on the Registration of Commercial Varieties, such as spinach; cereals; maize and sorghum; forage crops, herbage plants, turf grasses and grain legumes; oil and fibre crops; vegetables; grapevines; stone and pome fruit trees; citrus fruit; strawberries; olive trees; and fig trees.
9a. The aim is to ensure the health and high quality of new plant varieties.
9b. This does not hinder the marketing of plant varieties; rather, it regulates the authorisation of new ones.
