5. Draft decree on the protection of bees and other pollinating insects and the preservation of pollination services when using plant protection products

The purpose of this draft decree is to regulate the authorisation and use of plant protection products on crops that are attractive to pollinators during the flowering period, in order to protect pollinators from these products. It repeals and replaces the Decree of 28 November 2003 on the conditions of use of insecticides and acaricides for agricultural use to protect bees and other pollinating insects.
The draft decree provides for an ad hoc assessment by the National Agency for Food, Environmental and Occupational Health & Safety (Anses) when use during flowering is claimed. It also regulates the treatment times for products authorised for such uses in order to avoid the presence of bees as much as possible. It provides for derogations in order to take into account the working conditions and the need for emergency treatment or the treatment of regulated pests. Finally, it also provides for a transitional period for the entry into force of the provisions, in particular with regard to the provision of data necessary for the assessment by Anses.
9. For several decades, there has been a worrying decline in wild pollinating insects and increases in honeybee colony losses. Various factors influence their survival and development: the areas’ capacity to host them (providing habitats and food resources), biological hazards that cause disease, predators, parasites, pesticides, climate change, human activities and the anthropoisation of environments, the ways in which territories, in particular agricultural, forestry and urban areas, are managed and used.
The notified measures are based on the recommendations of the National Agency for Food, Environmental and Occupational Health & Safety (Anses) and on work involving representatives of the agricultural and beekeeping professions, technical and scientific institutes, environmental protection associations and administrations.
