5. Decree on the authorisation procedure for natural substances of biostimulant use

6. The draft decree concerns natural substances of biostimulant use (according to the definition of fertilisers).

Article L253-1 of the Rural and Maritime Fisheries Code provides that a natural preparation of low concern is composed exclusively of either basic substances, or natural substances of biostimulant use. With regard to the second category, the same Article refers to a decree to lay down the authorisation procedure for natural substances of biostimulant use. The purpose of this decree is to specify that natural substances of biostimulant use are authorised, if they are included on a list published by order of the Minister for Agriculture. The draft decree also specifies the conditions for inclusion on this list and the procedures for the amendment or withdrawal from said list. It also lays down the provisions concerning the advertising of natural preparations of low concern composed exclusively of natural substances of biostimulant use.

9. The aim of this draft is to provide for a streamlined procedure allowing the placing on the market and use of preparations composed exclusively of natural substances of biostimulant use, if these substances do not demonstrate any adverse effects on human or animal health or the environment.
In order to be authorised, these substances must have first been subject to an evaluation by the French Agency for Food, Environmental and Occupational Health & Safety, in order to guarantee this safety or be included on the pharmacopoeia and authorised to be sold as medicinal plants. The authorisation of these substances will also be broad in scope.
