8. Article 1 proposes to include in Act No 2004-575 of 21 June 2004 for trust in the digital economy the definition of social networks set out in the Digital Markets Act (DMA).
Article 1a extends the scope of infringements which platforms must combat; these include violence such as cyberbullying or blackmail.
Article 1b sets out an obligation to disseminate anti-harassment messages and to inform those who report about the support structures available for online harassment.
Article 2 establishes a digital age of majority, set at 15 years old, for registration on social networks and use thereof, unless expressly authorised by one of the parents/guardians. Social media service providers are also subject to information obligations towards users under 15 years of age and towards the parent/guardian (conditions of use of data, time of use, risks related to digital uses, etc.). Social media service providers are required to enforce these obligations, in accordance with procedures defined by decree of the Council of State. In case of non-compliance, administrative penalties may be imposed by the French Public Authority for the Regulation of Audiovisual and Digital Communications (ARCOM).
Article 3 introduces a time limit for responding to judicial requests: it provides for a penalty for online platform providers if they do not comply with the request of a judicial authority to obtain the disclosure of identification data within 10 days of receipt of the request or, in case of an emergency resulting from an imminent risk of serious harm to persons, within eight hours.
Article 4 calls on the Government to submit to the Parliament a report outlining the consequences of the use of platforms, excessive information and exposure to false information on the physical and mental health of young people, especially minors.
Article 6 sets out the conditions for the entry into force of the provisions.
9. The use of social networks by children and young adolescents poses a dual challenge with regard to public health and child protection for all of our societies.
These minds, which are particularly vulnerable because they are in the process of being developed, are confronted with the economic interest of the concerned platforms: these aim to maximise the duration of use of their services by individuals, regardless of their age. It is the “attention market”, an optimised solicitation of the human brain through algorithms, that generates a constant desire for new digital content for brain stimulation purposes.
Social networks therefore have major negative impacts on younger people. It is the duty of the legislator to intervene by setting an age limit, the necessary threshold of maturity at which a minor is capable of registering alone, with informed consent, on a social platform. Below this threshold, platforms will have to collect proof of the authorisation of at least one of the parents/guardians.
