The Regulation implements the new provisions introduced by Legislative Decree No 177/2021 by which Directive (EU) 2019/790 (Copyright Directive) was transposed into the Italian Law on the protection of copyright and related rights through the recognition of adequate remuneration proportionate to the use of protected works.
In particular, the Regulation covers the following areas (1) assistance in reaching contractual agreements for the granting of a licence for the use of audiovisual works on video on demand services, (2) information and communication obligations for transparency purposes, including through the exercise of the relevant sanction powers, (3) the contractual adjustment mechanism, (4) criteria for measuring the greater representativeness of the collective management
bodies, aimed at identifying organisations authorised to conclude extended collective licences on behalf of non-associated right-holders (so-called stateless artists), (5) Alternative Dispute Resolution (ADRs) procedures and for the settlement of disputes relating to (5.1) information obligations, and (5.2) the contractual adjustment mechanism, (6) the definition of adequate and proportionate remuneration of authors and artists, interpreters, and performers (AIEs) for the use of cinematographic and similar works in the absence of agreements between the parties.

To protect authors and artists, interpreters, or performers through the recognition of adequate and proportionate remuneration for the use of copyrighted works, ensuring that up-to-date, relevant, and complete information is obtained, including in order to adjust the remuneration. To provide, in addition, alternative dispute resolution mechanisms to protect these rights. To provide a procedure that ensures effective assistance in reaching contractual agreements for the granting of a licence for the use of works on video on demand services.
