5. Draft Act amending the Gambling Act (strengthened action against match-fixing, improved sanctioning options, legal basis for increased data processing, changed fees for slot machines and various adjustments to the gambling sector).

8. The Draft Act contains amendments to the Gambling Act to ensure a strengthened effort against match-fixing, modern rules and extended powers for the Danish Gambling Authority. The Draft Act is notified in its entirety, with the exception of the parts referred to in point 6 below.
The amendments include, inter alia:
1. It is proposed that the Danish Gambling Authority may require the licence holder to provide information in order to combat and prevent match-fixing. In addition, it is made possible to exchange necessary information on match-fixing between the Danish Gambling Authority, licence holders, other Danish and foreign authorities and entities and members of national platforms to combat match-fixing.
2. It is proposed that a Danish licence be required for suppliers of games to gambling operators with a Danish licence to provide gambling services.
3. It is proposed that the Danish Gambling Authority will have the legal basis for increased data processing, including profiling, combination and disclosure of gambling data in order to ensure compliance with the Act on Gambling Purposes and, among other things, to combat match-fixing and money laundering and to control the obligation of licence holders to protect players.
4. A new fee structure for slot machines with prizes is proposed so that a fee is paid depending on the gambling operator’s turnover, instead of per slot machine.
5. It is proposed to limit revenue-restricted licences by setting a turnover limit and by calculating sponsored prizes in cash or in kind, at the actual cost of the gambling operator. In addition, guessing competitions through SMS are separated into an independent revenue-restricted licence form.
6. Section 1, Nos 2, 3, 4, 5, 21, 38, 43, 48, 51, 52, 53, 54, 55, 56, 57, 58 are not notified as they are not considered to constitute technical barriers to trade: Among other things, it is proposed to introduce the possibility for the Danish Gambling Authority to issue injunctions and indictments for infringements of the gambling legislation, the Danish Gambling Authority is required to publish sanctions for infringements of the gambling legislation and a legal basis is introduced for the Danish Gambling Authority to require proof of identification of players when purchasing physical games in order to ensure that age limits are respected.

The partial liberalisation and modernisation of the gambling market, which entered into force on 1 January 2012, as well as experience with the gambling market after liberalisation in 2012, demonstrates an ongoing need for new remedies to combat crime, ensure up-to-date rules and effective supervision of the gambling market.
The fight against crime is achieved by enabling the Danish Gambling Authority to collect and exchange information as well as combine gambling data across gambling operators in order to combat and prevent match-fixing and money laundering.
Rules are brought up to date by introducing a turnover limit for revenue-restricted licences and a clarification of the calculation of sponsored prizes so that the flexible licence form is not used. In addition, the fee for slot machines with prizes is amended in order to allow licence holders to replace gambling machines on an ongoing basis.
Effective supervision of the gambling market is achieved by giving the Danish Gambling Authority the opportunity to issue injunctions, the publication of sanctions for infringements of the gambling legislation and the fact that the Danish Gambling Authority will be able to use gambling data to view player’s gambling patterns across operators.
