5. Decree of the Flemish Government amending the Decree of the Flemish Government of 1 June 1995 laying down general and sectoral provisions on environmental hygiene regarding plastic granules, fuels and flammable liquids, storage of
6. The amendments concern the conditions for plastic granules, fuels and flammable liquids, the storage of dangerous products and fuel oil tanks

8. The proposed amendments concern:
1 ° the introduction of general conditions for the control of pollution using
plastic granules;
2 ° the sectoral conditions for fuels and flammable liquids;
2 ° the sectoral conditions for the storage of dangerous products;
3 ° the environmental conditions for unclassified private fuel oil tanks with a capacity of
less than 5 000 kg.
Plastic granules can end up in the environment and aquatic systems due to accidental losses along the entire chain (production, processing, logistics transport and recycling). This poses significant risks to people and the environment. Conditions are foreseen to control the risks of loss of plastic granules. The current proposal is a first step to reduce plastic granulate losses with mainly target requirements.
The storage of fuels and hazardous substances poses specific risks, including the possibility of soil contamination with a significant remediation cost. The preliminary draft decision includes an urgent regulatory update, including a number of preventive measures concerning private storage facilities for fuel oil; the transposition of the research project codes of good practice on the construction and control of fixed containers for flammable liquids and dangerous products; as well as the partial transposition of the BAT (Best Available Techniques) determined for incubation (tanker location).
9. In accordance with Article 1.2.1, §1, DABM, the aim of Flemish environmental policy is:
‘1° Management of the environment through the sustainable use of raw materials and nature;
2° Protection; against pollution and abstraction, of humans and the environment, and in particular of ecosystems important for the functioning of the biosphere and which relate to food supply, health and other aspects of human life;
3° Nature conservation and the promotion of biological and landscape diversity, in particular through the conservation, restoration and development of natural habitats, ecosystems and landscapes of ecological value and the conservation of wild species, in particular those that are at risk, vulnerable, rare or endemic.’
Furthermore, on the basis of a balancing of interests between the various social activities, Flemish environmental policy aims to achieve a high level of protection based, inter alia, on the precautionary principle and the principle of preventive action, the principle that environmental damage should be tackled as a matter of priority at source, the standstill principle and the polluter pays principle.
Title II of the VLAREM (Decision of the Flemish Government of 1 June 1995 laying down general and sectoral provisions on environmental hygiene) contains, inter alia, the general and sectoral conditions applicable to classified establishments or activities.
The general environmental conditions apply to all classified establishments or activities. The sectoral environmental conditions apply to all determined types of classified establishments or activities. These conditions aim to prevent and limit unacceptable nuisances and risks that the establishments and activities concerned may cause. Where appropriate, they also seek to reverse the damage caused to the environment by the operation carried out by the establishment or activity.
