5. Draft Order on the quality, labelling and age verification system, etc. of
electronic cigarettes and refill containers, etc.
6. The Order concerns electronic cigarettes and refill containers with and without nicotine.

8. The amendments to the Order add requirements for the labelling of the packaging of electronic cigarettes and refill containers with nicotine.
The amendments to the Order concern:
- Unit packets and any outer packaging of electronic cigarettes and refill containers with nicotine shall bear the following nicotine cessation information: Stoplinien: 80 31 31 31 www.stoplinien.dk.
- The person who markets electronic cigarettes and refill containers with nicotine in Denmark must ensure that each unit packet and any outside packaging does not contain features that refer to taste, smell, flavourings or other additives or state that the product does not
contain them, with the exception of the words ‘with a tobacco taste’ or ‘with a menthol taste’.
The additions in relation to the existing Order appear with amendment markings.

The amending Order is an implementation of the agreement of 14 November 2023 on a prevention plan targeting the use of tobacco, nicotine and alcohol by children and young people, concluded between the government (Socialdemokratiet [Social Democrats], Venstre [Liberals] and Moderaterne [Moderates]), Socialistisk Folkeparti (Socialist People’s Party), Danmarksdemokraterne (Denmark Democrats), Det Konservative Folkeparti (Conservative People's Party) og Alternativet (The Alternative).
The agreement contains 30 initiatives, and together they are intended to contribute to reducing the consumption of tobacco, nicotine and alcohol by children and young people and to support more inclusive communities.
The amendments to the Order implement the prevention agreement with regard to the initiative on stricter product requirements for e-cigarettes.
Children and young people are particularly sensitive to nicotine and become addicted more quickly than adults. Nicotine negatively affects the brain and can have a serious impact on one's ability to learn, concentrate and pay attention. Nicotine can also have a detrimental effect on one's mental health and help provoke symptoms of anxiety and depression. The additional requirements in the Order are intended to help raise awareness of where to get advice to get out of nicotine addiction and to help ensure that electronic cigarettes and refill containers are not attractive to children and young people by referring to tastes and smells. In this context, it may be noted that the Danish Health Authority considers flavourings to be a leading reason for young people to try nicotine products.
Point 7
This is an existing Order which is being revised to add labelling requirements for electronic cigarettes and refill containers containing nicotine. The new requirements are shown with amendment markings.
No changes have been made to the requirements included in the existing Order, only new requirements have been added. The existing Order transposes parts of Directive 2014/40/EU of the European Parliament and of the Council of 3 April 2014 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco and related products and repealing Directive 2001/37/EC, OJ 2014 L 127, p. 1.

electronic cigarettes and refill containers, etc. is laid down pursuant to Section 7(2), Section 8, Section 9(2) and Section 15(4) of the Act on electronic cigarettes, etc.

The additions to the Order follow notification 2024/326/DK. The draft Act includes a review of the financial impact and implementation impact on the public sector, the financial and administrative impact on the business sector, etc., as well as the administrative impact on citizens.
