8. This draft Regulation is based on the Archive Act 20xx and the Archive Decree 20xx. The number of adressees is limited, as this Regulation is solely adressed to government agencies, public bodies and private bodies with public authority.
This Regulation contains rules regarding:
- the durability of archival documents that are eligble for safekeeping during a certain timeperiod or forever;
- the organisation and access of archival documents;
- the building, renovation and protection of archive depots.
This draft Regulation replaces the ministerial regulation that is currently in place (Archive Regulation). The previous regulation was notified in 2009, with an amendment being notified in 2010. This draft Regulation aims at updating the existing regulation and laying down rules that govern archives in the digital age.
The following articles may contain technical requirements:
- Arts. 2.5, 2.6, 2.8 and 2.12 (metadata schemas and metadata relating to electronic signatures);
- Art. 2.9 (digital formats);
- Arts. 5.5 and 5.6 (fire safety and prevention measures);
- Arts. 5.3, 5.4, 5.7, 5.9, 5.10 and 5.16 (general depot construction and safety measures);
- Arts. 6.2 - 6.5, 6.7 and 6.8 (packaging, boxes, labels, chemicals, materials, paper, ink and toner).
This draft regulation contains three mutual recognition clauses (arts. 1.2-1.3 and 5.1).
9. This Regulation does not differentiate between national and international goods or services. Both have to comply with the technical requirements laid down in this Regulation.
This Regulation aims at protecting cultural and historical heritage and possessions. Furthermore, it aims to contribute to effective government policy and action, by strengthening the transparancy of the government as well as by protecting the durability of relevant government documents.
The requirements in this Regulation are suitable to achieve the legitimate aims mentioned above as they set out the basic conditions for the safekeeping and protection of archival documents in order to ensure their permanence as well as to protect their cultural or historic value. For example, if archival documents come into contact with harmful chemicals, they might be damaged or destroyed, losing their value forever. Regarding the requirements included in this Regulation, the choice has been made to select the least restrictive requirements possible. Therefore, this Regulation complies with the principle of subsidiarity.
This draft regulation contains three mutual recognition clauses (arts. 1.2-1.3 and 5.1).
