Regulation of the Minister/State Secretary for Infrastructure and Water Management of (...) amending the Environment and Planning Regulation, the Soil Quality Regulation and the Soil Remediability Assessment Regulation (Consolidated Soil Regulation 2026 by the Ministry of Infrastructure and Water Management).
6. The Consolidated Regulation provides for technical amendments (updates, resolving inconsistencies, correcting omissions, etc.) and policy-neutral amendments to the regulations as mentioned in the title under 5.

8. The Consolidated Regulation contains amendments to a number of ministerial regulations. These are the Environment and Planning Regulation, the Soil Quality Regulation and the Soil Decontaminability Assessment Regulation. The Consolidated Regulation contains policy amendments of minor importance as well as technical amendments. All of the aforementioned amendments pertain to the protection of the environment and the physical environment, as well as to safeguarding health and safety.
The following amendments relate to the Environment and Planning Regulation and may contain technical regulations that require notification:
- Article I, Part A (Article 7.1c Environment and Planning Regulation);
- Article I, Part D (Article 8.28b Environment and Planning Regulation);
- Article I, Part E (Annex II of the Environment and Planning Regulation).
The amendments relate to articles from the Environment and Planning Regulation. A mutual recognition provision is included in Article 1.3 of the Environment and Planning Regulation.
9. Article I, Part A, may contain technical requirements regarding the submission of reports on soil investigations. The new Article 7.1c of the Environment and Planning Regulation stipulates that the environmental data contained in soil investigation reports, as referred to in Sections 5.2.1 and 5.2.2 of the Activities in the Living Environment Decree (Bal) and Section 7.2 of the Environment and Planning Regulation, must be provided in XML format in accordance with SIKB0101.
Article I(D) may contain technical requirements on the calculation of the limit value for the permissible quality of soil for the construction of a soil-sensitive building in a soil-sensitive location. After all, references are no longer made to the Soil Risk Toolbox but to Concrit.
Article I(E) may contain technical requirements because a number of standards have been updated or given a different name or publisher.
9a. The following applies to all the amendments: they may contain the technical requirements necessary to protect the physical environment and safeguard health and safety. The provisions shall apply without distinction to all companies: they do not make any distinction between domestic and foreign goods and services.
