5. Preliminary draft law on contaminated waste and soil

This affects certain single-use plastic products indicated in Annex IV to the preliminary draft law, plastic trays that are packaging but do not fall under Annex IV, single-use plastic products, plastic multi-pack ring carriers, plastic sticks used in the food sector to hold products (sticks for candies, ice cream and other products), products made from oxo-degradable plastics, and cosmetics containing intentionally added plastic microbeads of less than 5 millimetres.

8. Title V of this preliminary draft law is dedicated to single-use plastic products. This title details measures to reduce the consumption of certain single-use plastic products by means of quantitative reduction targets, market introduction restrictions on new lines of plastic products and products containing plastic microbeads, measures related to product line design and marking requirements, and consumer awareness measures to reduce littering. For plastic bottles, the text sets out two different timelines for separate collection targets.
Finally, it governs the adoption of extended responsibility schemes for certain plastic products, indicating the costs that producers of these products must cover.
9. Within the framework of the European Strategy for Plastics in a Circular Economy, the EU has adopted Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment.
This directive has become a pillar of EU environmental policy to move towards a more circular plastics sector and to combat marine pollution from plastics, especially single-use plastics.
The addition of Title V to this preliminary draft law is intended to incorporate the provisions of the aforementioned Directive (EU) 2019/904 into national law, to further its objectives.

The regulation of single-use plastic products, which is the purpose of this procedure, falls under the preliminary draft law on contaminated waste and soil, which also transposes Directive (EU) 2018/851 of the European Parliament and of the Council of 30 May 2018 amending Directive 2008/98/EC on waste.
The transposition deadline for Directive 2018/851 has already passed. The authorities therefore request the application of the emergency procedure so that the preliminary draft law can be adopted as soon as possible, thus also transposing the aforementioned Directive into national law as quickly as possible.
