8. The fact that environmental information on the climate impact, raw materials and origin of fuel is to be provided to consumers is regulated in the Fuel Act (2011:219) and the Fuel Ordinance (2011:346). The Fuel Ordinance has been previously notified with Notification No: 2019/337/S.

The draft currently being notified involves the regulation of how reporting in accordance with the Fuel Act and the Fuel Ordinance is to be carried out. The draft rule means that reporting is to be done at product level, i.e. at the level at which a fuel supplier markets a fuel to the consumer.

The regulation is made in accordance with the Fuel Ordinance (2011:346), which has been notified with Notification No 2019/337/S. The underlying legal acts are presented there. This draft regulation does not entail any other Swedish sectoral rules.

The overall purpose of environmental information on fuels is to provide consumers with information on the environmental impact of fuels so that they can make informed consumer choices in their everyday lives regarding fuels and choose fuels that emit less greenhouse gases, see the notification of the Fuel Ordinance (2007:346) with Notification No 2019/337/S.

The goal of the Swedish Energy Agency's regulations is for fuel suppliers to report the environmental and climate performance for different fuel products in a uniform manner at filling devices and on the fuel suppliers' websites. The purpose is to make it easy for consumers to compare the environmental and climate performance of different products, so that the consumers can make a conscious choice between different products and between different fuels. For consumers to have sufficient information so as to be able to make a choice even within the same fuel type, e.g. between a diesel with a high mix of renewable raw materials and a lower proportion of renewable raw materials, the information is required at product level. Therefore, reporting is also proposed at product level.

The cost of carrying out reporting at product level has been assessed to increase administrative costs, but the increase is so low that it will not affect the product price per se (see the impact assessment of the draft).

The requirement to report at product level is a prerequisite for being able to provide information at product level (see notification of the draft regulations on the obligation to provide consumers with environmental information on fuel (STEMFS 2020:xx)). It is important that consumers are made aware of the differences between different fuel products in order to be able to make informed choices on the basis of a clear and coherent frame of reference. The requirements are therefore necessary and justified for reasons relating to the protection of the environment. The measures are therefore proportionate.
