5. Regulation of the Minister of Energy laying down detailed rules for the structuring and calculation of tariffs for gaseous fuels and the settlement of trade in gaseous fuels.

8. The Regulation concerns tariffs for gaseous fuels. It lays down:
• the rules for calculating prices and rates within a given tariff for transmission, distribution and storage activities, and for liquefaction of natural gas or regasification of liquefied natural gas,
• the calculation methods for prices and rates within a given tariff for trade activity, including under a comprehensive agreement,
• the pricing policy for connection to the network,
• the method of settling payments between energy companies and settling payments with consumers, including invoicing frequency and the scope of information provided to the consumer,
• the method of determining discounts for failing to meet the quality parameters for gaseous fuels and the quality standards for customer service,
• the rules for calculating additional fees charged to gaseous fuel consumers, including fees for the illegal consumption of gaseous fuels.

This regulation replaces the Regulation of the Minister of the Economy of 28 June 2013 laying down detailed rules for the structuring and calculation of tariffs for gaseous fuels and the settlement of trade in gaseous fuels (Journal of Laws [Dziennik Ustaw], item 820). The need to draw up a new regulation derives from Article 58(2) of the Act of 20 May 2016 on energy efficiency (Journal of Laws 2016, item 831), pursuant to which current provisions on tariffs remain in force until 31 March 2018. The new regulation does not significantly amend a number of best practices. New regulations have been introduced to allow for more flexible structuring of tariffs by, inter alia, introducing a new tariff group — consumers of gaseous fuel by means of a pre-paid measuring system.
Furthermore, the regulation provides for solutions which will improve air quality and make it possible to reduce the fees for connecting to the gas network. Taking environmental considerations into account and with the aim of raising awareness about energy efficiency among final consumers, the scope of information provided to final consumers has been extended.
The regulation also contains provisions strengthening the position of consumers, inter alia, when the supply of gas is interrupted or a gas network is sold.
