8. To ensure legal certainty for wireless local area network (WLAN) operators, the Act on electronic media [Telemediengesetz] shall clearly set out the extent of internet access providers' liability. Providers shall also be made exempt from many cost obligations currently in force, in particular for cautions. It shall be clarified that WLAN operators will not be obligated to register users in advance, to make a password compulsory, or to alter the service provision, though providers will still be free to take these measures voluntarily. It shall also be clarified that service providers may still be obligated to remove or block the use of information under general legislation by court or official orders, even if they are not responsible in accordance with §§ 8–10. For service providers pursuant to § 8(3), the act shall also stipulate the conditions under which court orders can be imposed on them to block the use of information, so as to prevent the law being broken again.
9. The Second Act amending the Act on electronic media, which entered into force on 27 July 2016, was also intended to provide WLAN operators with legal certainty to allow them to provide their WLAN services to third parties without fear of being cautioned or made liable for illegal acts committed by third parties.
On 15 September 2016, however, the Court of Justice of the European Union handed down its judgment in Case C-484/14 (McFadden v Sony Music). The judgment once again created legal uncertainty since WLAN operators were now concerned that they would have to encrypt their WLAN hotspots and that they were at risk of being cautioned. This would not only make it difficult to increase public WLAN provision, but would also restrict many new business ideas and stifle innovation.
With this in mind, the aim of the draft act is to provide WLAN operators with as much legal certainty as possible so that the increased demand for public internet access can also be met using WLAN.

15. There will be no new obligations or compliance costs for the German population, businesses or authorities. Public WLAN will be offered more frequently as a result of the legal certainty provided. The costs of mobile internet use should thus decrease owing to the additional provision of public WLAN. WLAN operators will not be liable for judicial or extra-judicial costs for court orders, and the number of cautions should also drop.
