5. Draft Act amending the Act on the management of packaging and packaging waste and certain other acts.

8. The aim of the draft Act is to introduce a legal framework for the functioning of the deposit system for:
— single-use plastic beverage bottles of up to three litres,
— reusable glass packaging for beverages of up to one and a half litres,
— metal cans for beverages of up to one litre.
A deposit system should be understood as a system in which, when selling beverage products in beverage packaging, a fee is levied, which is refunded at the time of returning the packaging or packaging waste without the need to present a receipt confirming that the deposit has been paid in advance. The unclaimed deposit will be used to finance the deposit system.
9. Article 9 of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment, hereinafter the ‘SUP Directive’, contains an obligation to ensure the separate collection of packaging waste generated from single-use plastic beverage bottles of up to three litres together with their caps and lids on the level of 77 % in 2025 and 90 % in 2029.
In addition, in Poland, part of glass packaging (mainly beer bottles) is covered by a deposit system, which is not regulated by law and was created on a voluntary basis by entities selling products in beverage packaging. However, it should be noted that the return of such packaging by consumers is frequently difficult. Not all stores accept such packaging, and customers are often confused, which most often results in that a bottle which could be returned goes into a waste container.
In addition, it should be remembered that metal cans make up about 30 % of beverage packaging on the Polish market. The inclusion of this type of packaging within a deposit system will not only increase the levels of collection and recycling of metal packaging waste, but also benefit economically the planned deposit system and increase convenience for consumers.
At the same time, it should be pointed out that the deposit system is the only tool to achieve the ambitious objectives set out in the Directive, as demonstrated by the experience of other Member States.
