5. Draft Order regulating the requirements and technical characteristics of gambling machines, their interconnection conditions and the systems necessary for their control and inspection.

This Order develops, on the one hand, the technical requirements and characteristics that must be met by gambling and auxiliary machines regulated by Decree 120/2016 of 27 July 2016 approving the General Regulation on gambling in the Autonomous Community of the Basque Country for approval and registration, as well as adapting the new subtypes and updating them to the new market requirements; and, on the other hand, the technical conditions and requirements that must be met by the systems of interconnection of the gambling machines in order for the play to develop in a reliable, safe and transparent way for users, all the systems and the machines integrated in it must be monitored with the Public Administrations with control powers in the field of gambling.

Having been 5 years after the entry into force of Decree 120/2016, and making use of the planning power of the Government of the Autonomous Community of the Basque Country, provided for in the second final provision of Law 4/1991 of 8 November 1991 on Gambling of the Basque Country, Decree 19/2022, of 8 February 2022, was issued, amending the decree approving the general regulation of gambling in the Autonomous Community of the Basque Country.
Decree 19/2022 has introduced significant changes in the regulation of gambling and auxiliary machines, and their interconnection:
— aspects relating to the operation of the games are amended in order to ensure compliance with the parameters of the machines relating to the speed of the game, percentage of return of prizes and maximum prize; specifications to improve its monitoring and ensure understandable rules of the game for the consumer/user.
— the definition of the modifications of machine models is refined in order to limit what can be considered a non-substantial and substantial modification.
— the obligation to describe the operation and management of the common games and prizes of multi-position machines in the approval files is regulated.
— for the purpose of percentage return of machines, the determined cycle of consecutive consignments is established for all subtypes of type B machines, and the statistical cycle for type C machines.
— it is necessary to regulate internal interconnection systems that lack specific technical specifications as opposed to external interconnection systems.
- In addition, certain aspects relating to machine counters must be specified in order to improve the safety of operations.
In Articles 111, 113 and 121 et seq., the General Regulation on gambling differs from its regulation by order specifying the technical requirements and characteristics of gambling and auxiliary machines and interconnection systems.
In light of the above, the need to regulate the requirements and technical characteristics of gaming machines of the types “B”, “C”, auxiliary machines and their interconnection conditions, both internally of the premises themselves, and external (between different gambling venues), is appreciated in order to adapt them to the amendments referred to in the aforementioned Decree 19/2022 of 8 February 2022, amending the decree approving the general regulation of gambling in the Autonomous Community of the Basque Country.
