This notification also constitutes a notification within the meaning of Article 8 of Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC, in accordance with point 7.
Decree No 7/2015 of the National Media and Infocommunications Authority (NMHH) of 13 November 2015 on national frequency allocation and on the rules of frequency band use is amended in order to meet the international requirements, mainly related to the decisions of ITU (International Telecommunication Union) and CEPT/ECC (Electronic Communications Committee of the European Conference of Postal and Telecommunications Administrations), as well as to fulfil the implementation obligations resulting from changes in EU rules. The amendment also serves the purpose of creating or clarifying rules in connection with the introduction of new applications, user needs, and the implementation of technical clarifications in the text which have become necessary based on enforcement experience.
The draft transposes Commission Implementing Decision (EU) 2022/2324, according to which even 5G can be used for mobile communications services on board aircraft. In addition, Commission Implementing Decision (EU) 2022/2307 contains specifications for 5 GHz WAS/RLAN (Wireless Access System/Radio Local Area Network) devices that can be installed in motor vehicles, and the draft incorporates these specifications into Hungarian law.
Due to the increased demand for broadband mobile data transmission, in the case of the 23 GHz frequency band a need has arisen to use larger channel bandwidths than those provided for in the current legislation. As a result of harmonisation of the civil and non-civil aspects, several channels will become available for civil use according to the draft.
The demand for a spectrum for wireless broadband access is also constantly increasing, and in this context the provisions for the designation of bands, as laid down in ECC Decision (22)06 on harmonised technical conditions for mobile/fixed communications networks (MFCN), are transposed for the 42 GHz band. This allows technical planning before opening the frequency band for mobile purposes.
According to the draft, in line with the government’s needs, non-civil 410-415/420-425 MHz broadband digital PPDR (Public Protection and Disaster Relief) systems, which are currently in “planned” status, can also be designated for use solely for EDR purposes, and the sub-bands designed for non-civil broadband digital PPDR systems in the 694-790 MHz frequency band will be designated in order to meet non-civil needs in the 700 MHz spectrum.
Changes in the regulation of SRDs, i.e. short-range devices, and in standardisation results have made it necessary to amend the technical requirements for intelligent transport systems (ITS) in the 5 GHz band.
Taking into consideration the withdrawal of recommendations for fixed point-to-point systems in the 57-64 GHz frequency band and the restructuring of the relevant regulation, the national regulation will also be subject to amendment.
The draft includes updated provisions to ensure the conditions in Hungary for the global VDES (VHF Data Exchange System), which will be introduced in the maritime mobile service, in the 160 MHz band. The broadcasting possibilities for beginner radio amateurs are expanding in the 7 and 14 MHz bands.
The draft also includes a review of expired or upcoming deadlines, thus addressing issues related to the use of licences in the 160 MHz band.
In addition to the above, the draft makes the technical clarifications, text harmonisation and other editorial changes and simplifications that have become necessary on the basis of enforcement experience.
9. The purpose of the amendment of the NMHH Decree is to meet the international requirements, mainly related to ITU (International Telecommunication Union) and CEPT/ECC decisions, and to fulfil the implementation obligations due to changes in EU rules, as well as to create and clarify rules related to the introduction of new applications and user needs, and to implement technical clarifications in the text on the basis of enforcement experience.
