8. Pursuant to the present amendment to Act CLV of 1997 on consumer protection (hereinafter: Consumer Protection Act) in order to protect children’s health, it is prohibited to sell or serve energy drinks of a specified composition to persons under the age of eighteen. The Consumer Protection Act authorises the Government to determine by decree the composition of energy drinks that cannot be sold or served to persons under the age of eighteen years.
9. Energy drinks are beverages designed to increase physical performance and mental vigilance, and are available on the market in a variety of flavours and compositions to meet consumer and producer needs. They contain stimulant substances that help reduce fatigue and increase the level of energy in the organism.
From a nutritional-health point of view, it is a negative trend that the majority of young people nowadays consider energy drinks to be fashionable, almost like soft drinks, which they consume without limit, ignoring their caffeine content, which can trigger even more serious symptoms, depending on individual sensitivity. As a result, the share of energy drink consumers under the age of 18 is steadily increasing, with recent surveys showing that 10 % of secondary and middle school students consume energy drinks on a daily basis. In recent years, there have been hundreds of cases of young people seeking medical attention for energy drink overconsumption. The available expert views (Hungarian Society of Cardiology, National Centre for Public Health and Pharmacy) are consistent on the fact that excessive consumption of energy drinks by young people poses a significant health risk due to its impact on the cardiovascular system. Caffeine enhances the function of the skeletal and heart muscle and acts as a diuretic, resulting in 60 % of vitamins and minerals being excreted from the body. As a result, the immune system may be weakened, leading to additional health problems. It also affects the work of the respiratory system, raising pulse rates and blood pressure, putting the whole body in a more reactive state. The consumption of large amounts of caffeine can cause symptoms of caffeine overdose: severe nausea, vomiting, chest pain, rapid heart rate, restlessness, insomnia, and sometimes panic attacks. For people who are not used to drinking beverages containing caffeine, an overdose can even lead to death. The combined consumption of energy drinks and alcohol can cause permanent damage to the liver, heart and kidney. Both are dehydrating, so the intoxicating effects of alcohol are much more pronounced and can be fatal. As energy drinks have a stimulating effect and alcohol has the opposite effect, the two together cause a loss of control and situational awareness.
According to representatives of the Association for European Paediatric Cardiology, more and more of their patients are being hospitalised for overdoses. Due to the above risks, the Association is seeking to ban the sale of energy drinks to minors across Europe. According to data from the European Food Safety Authority, energy drinks are already consumed by children under ten years of age.
The aim of the amendment is to protect the health of persons under the age of 18 by prohibiting to sell and serve them energy drinks with a specified composition, the presence of which, at specified levels, poses the greatest risk to the health of young people.
