The Decree specifies the implementation arrangements of several provisions of Regulation No 2022/670 with regard to the provision of EU-wide real-time traffic information services, Regulation No 886/2013 with regard to data and procedures for the provision, where possible, of road safety-related minimum universal traffic information free of charge to users, and Regulation No 885/2013 with regard to the provision of information services for safe and secure parking places for trucks and commercial vehicles.
The detailed arrangements concern the definition of data holders and users, the definition of digital data, the road networks on which the information deployment obligations apply, the arrangements for access through the national access point and the characteristics of the data and information, including their metadata.
The Decree also specifies Articles D 1514-1, D 1514-2, and D 1514-3 of the Transport Code relating to access to vehicle data for various public services. The detailed arrangements concern the elements to be provided to the national access point by manufacturers of motor land vehicles.
The draft Order specifies various points of the Decree:
- events and circumstances covered by Regulation 886/2013 on safety-related information
- the characteristics and metadata of the data referred to in Regulations 2022/6740 and 886/2013
- the data quality requirements of Regulation 2022/670
- the harmonised presentation methods by information service providers of information on the presence of operating or intervention agents on the routes
- the functionalities of the national access point and its technical characteristics
It also specifies certain provisions of Articles D 1514-1, 2 and 3 of the Transport Code by:
- defining the data characteristics;
- defining the time limit for the transmission of vehicle data;
- defining the road networks on which vehicle data are to be transmitted to the beneficiary public services
- defining the security measures to be applied when transmitting vehicle data
- laying down the arrangements for informing the data subject.

The harmonised application of Regulations 2022/670, 885/2013 and 886/2013 requires clarification in French law, on the one hand, of the data access obligations and the obliged persons (which falls under the legislative level) and, on the other hand, of the characteristics of the data with regard to various national provisions on road regulations, signs and operations.
The above-mentioned Regulations 885/2013 and 886/2013 require Member States to define the perimeter in scope, and the national road network was initially designated. This perimeter must be changed in the light of the scopes chosen for the application of the revised ITS Directive and the fact that certain local authorities have taken charge of sections of the trans-European transport network which are thus no longer an integral part of the trans-European transport network.
In addition, the deadlines for applying the data accessibility measures provided for in Regulation 2022/670 depend on network perimeters that should be specified by Decree.
The functionalities of the national access point, introduced by the above-mentioned Regulations, also need to be specified.
With regard to vehicle data, which are the subject of a legislative act at national level (Articles L 1514-1 to 3 of the Transport Code) defining the public services (police and gendarmerie forces, fire and rescue services, road managers, mobility authorities) having access to three sets of data (security-related information, infrastructure observation, traffic observation), the Order ensures the consistency of the characterisation of the data with those resulting from the above-mentioned European regulations; it specifies the deadlines for the transmission of these data, the networks on which the data must be made accessible, the conditions for securing the transmission of data and the arrangements for informing the data subject.
