5. Decree of ... fixing the adjustments applicable to the financial contributions paid by producers when they incorporate recycled plastic materials

8. The principle adopted is that of financial support for the incorporation of recycled plastic material via an amount proportional to the mass of recycled plastic material incorporated, as already exists in a number of specifications (‘incorporated tonne premium’).
This premium replaces all current arrangements for rewarding the incorporation of recycled plastic material in force in the specifications.
As this decree aims to encourage the incorporation of recycled plastic material, no penalty is proposed, as most of the specifications already provide for penalties related to the presence of recycling disruptors.
The mechanism is due to come into force on 1 January 2026.
The following premium amounts are proposed:
1. EUR 450 per tonne of incorporated recycled plastic material from the recycling of waste products from other extended producer responsibility streams than the product into which the recycled plastic material is incorporated;
2. EUR 550 per tonne of recycled plastic material incorporated from the recycling of waste products from the same extended producer responsibility chain as the product in which the recycled plastic material is incorporated;
3. EUR 1,000 per tonne of recycled plastic material incorporated from plastic resins which, in the current state of scientific and technical knowledge, are considered difficult to recycle in order to be incorporated into contact-sensitive packaging.
These amounts shall be the same, regardless of the resin and the supply chain concerned, in order to guarantee the legibility of the device over time and to provide the necessary visibility for all stakeholders.
The following sectors, within the meaning of Article L. 541-10-1 of the Environmental Code, shall be included in the scope of the decree:
- packaging used to market products consumed or used by households, including those likely to be consumed by households and those consumed away from home, printed paper, with the exception of books, issued, including free of charge, by principals or on their behalf, and paper for graphic use, intended for end users who produce household and similar waste;
- packaging used to market products consumed or used by professionals and which are not already covered by the previous paragraph;
- electrical and electronic equipment, whether intended for use by private individuals or professionals;
- containers of chemical products that may present a significant risk to health and the environment that are likely to be collected by the public waste management service;
- furnishings and upholstered seating or sleeping products and textile decorative elements;
- toys, except those falling under the principle of extended producer responsibility under another category;
- sporting and leisure goods, except those covered by the principle of extended producer responsibility under another category;
- do-it-yourself and garden items, except those covered by the principle of extended producer responsibility under another category.
Each product specification shall be amended accordingly.
The following products shall be excluded from the premium:
- products incorporating recycled plastics into a composite matrix, defined in Article 1 of the draft decree, in order not to reward the incorporation of recycled plastic material leading to a decrease in the recyclability of the product;
- products containing recycling disruptors identified by the approved eco-organisations on the corresponding product category.

Every year, almost 5 million tonnes of plastics are produced in France, of which just over 10% are produced from recycled materials.
European obligations to reincorporate plastic should help to increase demand for recycled plastic over the next few years, particularly in packaging and vehicles. However, these obligations will not come into force until 2030, except for PET bottles.
It therefore seemed necessary to use the leverage of the modulation of the financial contributions provided for under the EPR schemes in order to make it economically attractive for marketers to use recycled materials as an alternative to the use of virgin material.
Such modulations have existed since 2019 in the household packaging EPR sector and are developing in other sectors.
The anti-waste law of 2020 has already increased the ambition and the amounts allocated to the sectors that have introduced a bonus for the incorporation of recycled plastic material, but modulations remain weakly mobilised due to the lack of harmonisation between the sectors and communication on the system.
This is why work on establishing a harmonised framework for these modulations was initiated last autumn, following the announcement by Minister Agnès Pannier-Runacher on 3 October 2024.
They have led to the preparation of the draft decree subject to this notification.
