The subject of the notification is a draft decree on reporting in gambling, which is being issued on the basis of authorisation pursuant to § 133(1)(a) of Act No 186/2016 on gambling, as amended (hereinafter the ‘Gambling Act’). The draft Decree updates the existing legislation in the area of reporting to take into account the changes made by the amendment to the Gambling Act and Act No 187/2016 on gambling tax (hereinafter the 'Gambling Tax Act'), which came into effect on 1 January 2024. The draft decree thus covers, for example, the reporting of gaming and financial data for a new type of online live game, known as a live dealer game (broadcast live games), the operation of which was only made possible by an amendment to the Gambling Act from 1 January 2024, the cancellation of temporary user accounts, a new system for setting up and operating self-restriction measures, and a new determination of the basis for the individual tax on other live games (i.e. live games not operated via the internet). The draft decree also proposes amendments that will have a positive impact on the processing and adoption of data packages containing automated output and the reduction of the volume of data reported by gambling operators and the streamlining of the entire reporting system. This includes, for example, changing the frequency with which data is sent under the large reporting model from the current three times per calendar day to the proposed once per calendar day, which will result in more effective reception of gaming and financial data, narrowing the scope of some of the data sent (e.g. data on rejected bets will no longer be sent) or increasing the number of characters of selected identifiers, which currently causes technical problems for gambling operators.
The draft decree largely incorporates the existing legal framework, building on the established principles for reporting, the content of automated outputs, and the principles for updating individual records.

9. The proposed draft Decree builds on the amendments to the Gambling Act, the Gambling Tax Act and practical experience.
The current legislation does not correspond to the changes that have occurred in legislation as a result of amendments to the Gambling Act and the Gambling Tax Act. These include, for example, a new type of live game (broadcast live game), the cancellation of temporary user accounts, changes relating to self-exclusion measures or changes in the calculation of the partial tax base for land-based live games.
From the point of view of the content of the data to be reported, the current legislation in the area of gambling reporting is also not entirely satisfactory in the light of practical experience. In this regard, after almost six years, the draft decree also brings about a fundamental optimisation of the reported and processed data and a reduction in their total volume, which should ultimately lead to a reduction in the burden on both gambling operators and civil authorities. At the same time, working with the data will become more efficient and their clarity will increase.
As part of this data optimisation, it is proposed, for example, to change the frequency of data transmission, specifically by reducing the obligation to transmit reported data three times a day to only once a day for the entire calendar day, or certain data that has become redundant as a result of new legislation and based on previous experience will be omitted, such as the obligation to send data on every change in the odds of a betting opportunity, the rejection of a betting slip in fixed-odds betting, and the duration of participation in a technical game. Ultimately, these measures reduce the administrative burden on both the operator and the State, while maintaining the relevance and weight of the reported data.
It is therefore clear that, in view of the need to bring the area of reporting into line with the Gambling Act and the Gambling Tax Act, and also in order to increase the effectiveness of gambling control and tax administration in the field of gambling, the proposed legislation is absolutely necessary.
