Concerns Regarding Hungary’s National Legislation Exceeding EU Regulation Requirements
CAOBISCO wants to express its concern over Hungary’s stricter national technical Regulation, currently under TRIS scrutiny, which goes beyond what is stipulated in Regulation EU 2024/1143 on geographical indications. In particular, our concern is on the stricter definition of ‘economic operator’, as laid down in Article 37 (5) of EU 2024/1143. This different interpretation contradicts the principle of harmonized standards within the single market and sets an undesirable precedent. Allowing Member States to impose stricter interpretations undermines regulatory consistency and could encourage similar actions in other areas.
We strongly urge alignment with Regulation EU 2024/1143 to maintain legal certainty and coherence across all member states.
Additionally, Hungary’s interpretation of the term 'economic operator' poses complications for private labels and products with protected designations produced under contract manufacturing, since according to the Hungarian Regulation, the producer or any economic operator involved in any stage of production must be displayed within the same field of vision.
