5. Order on prior information to be provided to purchasers of plants liable to be harmful to human health

8. The draft Order is issued pursuant to Article L1338-3 of the Public Health Code. It determines:
- the list of plants liable to be harmful to human health (risk of intoxication by ingestion, risk of respiratory allergy, risk of mucocutaneous reaction, risk of abnormal cutaneous reaction in case of exposure to the sun);
- information on the health risks associated with these plants and on the means of protecting against them which is to be the subject of the information provided to the purchaser prior to the sale by the seller or the distributor;
- the procedures for delivering this information (informative materials, dissemination methods, etc.) according to the type of sale (retail, distance selling, public procurement).
Forest reproductive material, plants sold for consumption, cut flowers, foliage branches, cut trees retaining foliage, plant tissue cultures and grass seed mixtures are excluded from the provisions of this Order.

According to an expert report published in 2014 by the French National Agency for Food Environmental and Occupational Health and Safety (ANSES), 20% of children over 9 years old and 30% of adults are allergic to pollen in France. One of the recommendations made by ANSES to reduce the planting of plants with allergenic pollen plants is to provide information to the general public and communities prior to the purchase of certain ornamental plants with highly allergenic pollen and to encourage the diversification of plants introduced.
In addition, poison control centres, which receive reports of adverse health effects, have observed a growing increase in the number of reports involving plants since 1999 (2,111 reports in 1999, 6,782 in 2006 including 28 serious cases, 8,744 in 2015 including 20 serious cases). A significant proportion of these reports concerns frail and vulnerable population groups such as children and allergy sufferers and is associated with effects which are sometimes serious (intoxication, death, etc.).
Finally, various stakeholders, including communities and schools, have expressed their strong desire to have access to lists of plants to be avoided in public or private spaces.
Thus, the prior information on the health risks associated with certain ornamental plants is intended to inform the general public so that, where appropriate, they can adapt theirs purchasing behaviour and practices, and the communities so that they can adapt purchases to sensitive population groups who frequent certain public spaces. This prior information must enable everyone to act with the aim of preserving health.
The proposed scheme is based on a national expert report on lists of plants and on information on the associated risks and ways of protecting against them. It is the result of a consultation procedure with consumers and professional organisations representing distributors and sellers of ornamental plants. This consultation made it possible to adapt the conclusions of the expert report to current practices, in particular on the information procedures and on certain plants posing a risk but which are not sold, which were removed from the annex to the Order.
