5. Title: Decree of the Ministry of Transport of the Slovak Republic amending Decree of the Ministry of Transport and Construction of the Slovak Republic No 140/2018 laying down the details on the installation of gas equipment, as amended
6. Product/Service details: Installation of gas equipment in road vehicles
7. Notification under another EU act:
8. Summary: The aim of the present draft Decree is to supplement the provisions governing the training of gas equipment installation technicians. Act No 249/2026 amending Act No 106/2018 on the operation of vehicles in road traffic and on amendments to certain acts, as amended, and amending certain acts allows gas equipment installation technicians to undertake continuous training while their certificates remain valid, as an alternative to the current form of training. In view of the above, the draft Decree lays down the particulars of applications for continuous training for gas equipment installation technicians, the method and scope of continuous training, and the details regarding the issue and particulars of the certificate of completion of continuous training.
A further aim of the draft Decree is to update and clarify certain provisions governing record-keeping and the performance of actions through the national information system, as well as to expand the scope of the data recorded in connection with the activities of gas equipment installation stations. The draft amendment to the Decree also responds to needs arising in practice.
9. Brief statement of reasons: The purpose of the draft Decree of the Ministry of Transport of the Slovak Republic amending Decree of the Ministry of Transport and Construction of the Slovak Republic No 140/2018 laying down the details on the installation of gas equipment, as amended by Decree No 85/2021, is to increase the professional competence of gas equipment installation technicians throughout the period of validity of their professional qualifications, ensure that their professional knowledge is kept up to date on an ongoing basis, streamline the performance of professional activities through digitisation of selected processes and supplement the recorded data necessary for the performance of technical supervision and inspection activities.
The draft introduces continuous training for gas equipment installation technicians, divided into three parts, and lays down the time intervals for completing each part and the method for assessing their knowledge. It also enables the electronic submission of applications for training, regulates the exchange of data between specialist bodies and facilitates the performance of selected actions through the national information system. In addition, it extends the scope of data recorded during checks on the conformity of the installation and during the replacement of a gas tank and its accessories, filter or flexible gas hose.
9a. Appropriateness of the measure for achieving the objective pursued: The proposed legislation is an appropriate means of achieving the objectives pursued, since it responds to the need for continuous maintenance and updating of the professional knowledge of gas equipment installation technicians, as well as to the need to streamline processes and improve the recording of operations related to the installation and maintenance of gas equipment.
The introduction of continuous training during the validity of the certificate creates a mechanism for regular familiarisation of technicians with new technologies, changes in legislation, technical standards and working practices. The division of the training into three parts, the determination of time intervals and final examination make it possible to verify the acquired knowledge on an ongoing basis. The electronic submission of applications and the use of the national information system support a more uniform and efficient performance of selected actions. Expanding the scope of the recorded data improves the traceability of work carried out on a vehicle and supports the performance of technical supervision and inspection activities.
The proposed measures are substantively linked to the objectives pursued and lay the groundwork for attaining them.
9b. Necessity: The proposed legislation is necessary to ensure the continuous development of the professional competence of gas equipment installation technicians and to update the record-keeping and data processing procedures in the field of vehicle operation. The initial training or a refresher course alone may not ensure that technicians are kept regularly up to date with new technologies, changes to legislation, technical standards and installation procedures throughout the certificate’s period of validity.
The introduction of continuous training with specified intervals, content and a prescribed method of assessing knowledge provides a uniform framework for all technicians concerned. The electronic submission of applications and the use of the national information system make it possible to streamline selected administrative actions and data exchange. Supplementing the data recorded during the installation and replacement of gas equipment components also facilitates the traceability of work carried out and the performance of state technical supervision.
The proposed approach builds on the existing system for the installation of gas equipment, training and record-keeping; according to the supporting documentation provided, the creation of new administrative structures is not envisaged.
9c. Excessive burden in relation to the objective pursued: The proposed legislation pursues legitimate objectives in the areas of maintaining the professional standards of gas equipment installation technicians, streamlining administrative processes and improving the recording of work carried out. Certain measures may impose time, organisational or administrative demands on technicians and the specialised entities concerned, in particular in relation to the completion of the three parts of continuous training and the final examinations.
These demands involve regular assessment of professional knowledge and the need to keep that knowledge up to date throughout the period of validity of the certificate. The possibility of submitting applications electronically and performing selected actions through the national information system can reduce the administrative burden and facilitate more efficient processing of data. Expanding the scope of the data recorded is intended to improve the traceability of work carried out and facilitate more effective technical supervision.
On the basis of the supporting documentation provided, the proposed measures appear to be proportionate to the objectives pursued. However, the documentation does not contain a quantification of costs or a detailed calculation of the time and financial burden on the entities concerned; the conclusion that the burden is not excessive is therefore based on a substantive assessment of the nature of the proposed measures and their expected benefits.
