5. Federal Act amending the Copyright Act (Copyright Act Amendment 202x – UrhG-Nov 202x)

6. The Copyright Act Amendment 202x, Federal Law Gazette (BGBl.) I No XX/XXXX (the Government Bill, 1178 d.B., was sent to the lower house of the Austrian Parliament (Nationalrat) on 18 November 2021; its adoption in the Nationalrat and the upper house of the Austrian Parliament (Bundesrat) can be expected in December 2021) introduces a new copyright-related right for producers of press publications, transposing into Austrian law Article 15 of Directive (EU) 2019/790 of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC.
The draft being notified adds the way in which the copyright-related right and the participation right of authors of works contained in the press publication may be exercised, which are not provided for by Directive 2019/790.

8. The draft stipulates that the new right against market dominant online platforms and search engines must be asserted through a collecting society. Against such service providers, the right is therefore to be exercised only collectively and not by the individual producers of press publications.
In addition, the participation right of authors (journalists) against the producers must be asserted through a collecting society.

The aim is for producers of press publications to only be restricted in their individual powers of disposition to the extent that this is necessary to protect them against misuse of a dominant position by search engines and social media services on which they are dependent to avoid economic disadvantages.
Directive 2019/790 does not provide for such a restriction of the new copyright-related right. However, its antitrust nature provides justification for it. The restriction is necessary to protect producers of press publications from exploitation by dominant service providers.
Directive 2019/790 also does not explicitly lay down in Article 15(5) that the participation right of authors (journalists) must be asserted through a collecting society; however, remuneration claims must generally be asserted through a collecting society. Moreover, the participation right is directed against the producer of the press publication and not an Information Society service. Ultimately, this addition also serves to transpose the principle of reasonable and proportionate remuneration under Article 18 of Directive 2019/790.

Reference to the basic texts: In the version of the Government Bill for the Copyright Act Amendment 2021, 1178 d.B., a paragraph requiring the right to be asserted through a collecting society is being added to § 76f of the Copyright Act, a paragraph is being added to § 115 making reference to the notification and an entry into force provision is being added to § 116.
