5. ROYAL DECREE APPROVING THE QUALITY STANDARD FOR OLIVE AND OLIVE POMACE OILS.

This aim of this Royal Decree is to establish a quality standard for olive oil and olive pomace oil to replace the standard by which such products are currently regulated, namely Royal Decree 308/1983 of 25 January 1983 adopting the technical and health regulations for edible vegetable oils, where it refers to olive and olive pomace oils.

This Royal Decree introduces the obligation for operators to maintain an internal record tracking system to ensure that olive and olive pomace oils always carry an accompanying document while in transit, and to report all movements of such products to a computer system maintained by the Ministry of Agriculture, Fisheries and Food.

It also lays down certain obligations such as the separation of facilities, as well as certain prohibitions such as the prohibition of mixtures or the placing of extra virgin olive oils packed in plastic containers on the retail market.

9. The current situation in the olive oil and olive pomace oil market requires adaptation of the specific regulations on these products, especially with regard to the production of olive oil and olive pomace oil in Spain, from a food quality perspective.

The regulations on olive oil are updated with a view to guaranteeing a high level of product quality and to prevent fraud within the sector as part of the general framework for updating the quality standards of the Ministry of Agriculture, Fisheries and Food.

Law 28/2015 of 30 July 2015 on the protection of food quality authorises the Spanish government to approve quality standards for food products, with the aim, inter alia, of adapting to the European Union regulation and of simplifying, modernising and enhancing existing standards as well as improving the competitiveness of the sector, including advancements brought about by technological innovation.
