5. Draft Order establishing the essential airworthiness requirements for ultralight motorised gliders (ULM) and amending the Order of 31 May 1982 adopting a new building regulation

The Order regulates the conditions for the design, mass production, initial and continuing airworthiness (also known as airworthiness maintenance) of ultralight motorised gliders (ULM) intended to be used in Spanish territory, including the obligations to be fulfilled by the organisations designing and manufacturing such aircraft.

The Order is of technical content, and consists of a preamble, 41 articles structured into seven chapters, and a final section composed of four additional provisions, two transitional provisions, one derogatory, three finals and an annex containing the essential airworthiness requirements to be met by all ULM-type designs for subsequent mass production.

9. In essence, the Draft is justified by:

(i) the need to comply with various safety recommendations presented to EASA and DGAC by the Civil Aviation Accidents and Incidents Investigation Committee (CIAIAC);

(Ii) the need to adapt national airworthiness regulation on ULM aircraft to technical developments in ULM-aircraft design and manufacture;

(iii) the need for such regulations to take into account that the industry designing and manufacturing these aircraft is relocating or internationalising;

(iv) as well as the need for national regulations to be proportionate to the European Union’s regulations for similar aircraft (of slightly greater weight than ULM aircraft), in particular for the one known as Part-21 Light.
