8. The proposed draft Royal Decree aims to amend, harmonise and clarify the current procedure for the notification of food supplements and enriched foods provided for at national level by three Royal Decrees on nutrients, plants and other substances.
At European level, the principle of notification is laid down in Directive 2002/46/EC of the European Parliament and of the Council of 10 June 2002 on the approximation of the laws of the Member States relating to food supplements and Regulation (EC) No 1925/2006 of the European Parliament and of the Council of 20 December 2006 on the addition of vitamins and minerals and of certain other substances to foods.
9. Currently, the marketing of nutrients, plants and other substances is regulated under Belgian law by three Royal Decrees. Namely, the Royal Decrees of 30 May 2021 on the placing on the market of nutrients and foodstuffs to which nutrients have been added, of 29 August 2021 on the manufacture and marketing of food supplements containing substances other than nutrients and plants or plant preparations, and of 31 August 2021 on the manufacture and marketing of foods consisting of or containing plants or plant preparations.
Following a decision by the Chamber of Administrative Litigation of the Belgian Council of State and the finding of uses that are fraudulent and for purposes contrary to those laid down by Belgian legislation of acknowledgements of receipt communicated in the context of the notification procedures, it has been decided to clarify the scope of the aforementioned texts, to amend the definitions contained in those texts in accordance with the relevant European legislation and to update, in a harmonised manner, the notification procedure in the three Royal Decrees concerning nutrients, plants and other substances.
This draft does not add any additional administrative burden for economic operators. The procedure for the introduction of the products concerned remains the same and the documents relating thereto reproduce the same information as currently provided for in the procedure applicable under Belgian law.
