This text aims to facilitate the repair of products and promote their durability, with a view to fostering a circular economy. It supplements the already existing provisions on the availability of spare parts from the other decrees implementing Law No 2020-105 of 10 February 2020 on combating waste and on the circular economy, and Law No 2021-1104 of 22 August 2021 on combating climate change and strengthening resilience to its effects.
The text applies to certain categories of goods where a spare part essential for the use of a good is no longer available for sale but can be produced using 3D printing. The text stipulates that, in such cases, the manufacturer or importer of movable goods must, subject to compliance with intellectual property rights, provide professional sellers, refurbishers or repairers – whether authorised or not – who so request with the design data for the spare part produced by means of 3D printing or, failing that, the technical specifications necessary for the creation of such a design.
9. The draft decree currently being notified is issued pursuant to the third paragraph of Article L. 111-4 of the French Consumer Code, as amended by Article 19 of Law No. 2020-105 of 10 February 2020 on combating waste and the circular economy (known as the ‘AGEC’ Law).
This draft aims to make it easier to repair products and enhance their durability as part of a circular economy approach, by using three-dimensional (3D) printing to produce spare parts. It also aims to reduce the environmental impacts generated by the production of new goods as well as the production of waste.
9a. The notified measure aims to tackle resource waste and overconsumption. It drew on an empirical study by the French Environment and Energy Management Agency (ADEME), which analysed data from a variety of sources (literature reviews, interviews with representatives of the various types of operators involved, and expert consultations). The results of this research indicated that three-dimensional printing could have an environmental benefit, in view of the possibility of extending the period of use of the products that this printing technique allows.
To this end, the notified measure helps to encourage the repair of goods for which a spare part essential for their use is no longer available for sale but could be manufactured using 3D printing.
The measure targets several categories of products that present significant challenges with regard to repair as these products are widely used by consumers and the costs of purchasing new products or of repairing the products are significant.
9b. Directive (EU) 2024/1799 of the European Parliament and of the Council of 13 June 2024 establishing common rules promoting the repair of goods prohibits manufacturers from preventing repair by third parties using spare parts produced by three-dimensional printing. Article 13 of this Directive further provides that Member States (MS) must take at least one measure to promote repair.
The measure currently being notified sets out the operational arrangements for offering spare parts manufactured using 3D printing, in accordance with the conditions laid down in Article L. 111-4 of the Consumer Code. In doing so, the text contributes to the promotion of the repair of the good when the spare part is no longer available on the market.
As regards the scope of application, Article 5 of Directive (EU) 2024/1799 applies in particular to certain household appliances (household washing machines, domestic dishwashers, refrigeration appliances, domestic vacuum cleaners and tumble dryers), electronic display devices (including computer screens), mobile phones, cordless phones and goods containing batteries intended for use in light-duty vehicles. These categories of goods are covered by the measure.
The measure contained in the notified draft also covers categories not provided for in the Directive, such as light fittings, furnishings, passenger cars, vans, L-category vehicles, light means of transport (e.g. electrically assisted bicycles and motorised personal transport devices) and do-it-yourself and gardening tools.
However, the Directive does not prevent Member States from allowing spare parts to be manufactured using 3D printing for other categories of goods.
In view of the above, the notified measure constitutes the least restrictive and most proportionate means of achieving the intended objectives, namely to encourage the repair of goods and to combat the waste of resources and overconsumption.

The restrictions imposed by the measure on manufacturers and importers are strictly proportionate, as they target only parts that are unavailable, without discriminating between operators, whilst respecting intellectual property rights. The costs incurred in meeting these obligations remain limited and are justified by the expected environmental and socio-economic benefits, which include a significant reduction in waste and an extension of product lifespans, in line with the principles of the circular economy.
Interference in the internal market has been limited by the scope of the measure, which applies uniformly to all operators involved in the targeted product categories, without distorting competition. The assessment of the balance between the protection of the general interest – in this case, combating waste and promoting repair – and the constraints imposed on economic operators was carried out following an in-depth consultation of stakeholders (manufacturers, repairers, 3D printing professionals). The feedback received has enabled us to amend the text so as to soften its impact whilst maintaining its effectiveness.
If the targets are not met, the consequences could include an increase in waste volumes, a rise in the financial burden on consumers when replacing the goods in question, and a setback to the transition towards a more resource-efficient circular economy. Such a situation would, in addition, jeopardise efforts to combat over-consumption and preserve natural resources
