5. Draft First Act amending the Environmental Statistics Act and other acts
6. All types of packaging are affected. The following, amongst others, are addressed: packaging subject to the scheme participation obligation; transport packaging; sales and grouped packaging that does not typically accumulate as waste at the private final consumer after use; sales and grouped packaging holding filling materials containing hazardous substances; reusable packaging; single-use plastic products and lightweight plastic carrier bags.

8. The draft Act serves solely to transpose Union law. The subject of the draft is substantive amendments to the Environmental Statistics Act, which has existed in its current version since 2017. In order to comply with the new data requirements of the EU Waste Framework Directive, the EU Packaging and Packaging Waste Directive, the EU Single-Use Plastics Directive and the EU Sewage Sludge Directive, the corresponding surveys are required by law in the Environmental Statistics Act for the first time or in an amended form.
In the area of waste statistics, this will lead to a massive expansion of the packaging survey, for which, amongst other aspects, a completely new reporting system will have to be created. The details are laid down in the a paragraph (§ 5a), which is one of the central elements of the amendment.
9. The Act transposes EU law. In order to create the conditions and data basis for the new reporting, survey designs were chosen that are intended to ensure a balance between the quality of the data collected and the burden on businesses and authorities associated with the data collection.
