5. Decree on the procedures for informing consumers of the consumable nature of foodstuffs after their minimum durability date

7. - Directive 94/55/EC, Article 5(4) on the approximation of the laws of the Member States with regard to the transport of dangerous goods by road
- The aim of the Decree is to clarify how operators who so wish can provide additional information on the minimum durability date as provided for in Article 24 of Regulation (EU) No 1169/2011, the expression of which, as set out in Annex X to that Regulation, is often misunderstood by the consumer.

8. The decree is adopted pursuant to Article L. 412-7 of the Consumer Code resulting from Article 35 of Law No 2020-105 of 10 February 2020 on combating waste and on the circular economy. It specifies the indication to be used by professionals when, as permitted by Article L. 412-7 of the Consumer Code, they choose to inform consumers that a food product remains consumable after its minimum durability date passes.
Three possibilities are provided for:
- the addition of the words ‘For optimal taste’, before the minimum durability date is indicated;
- the words ‘This product may be consumed after this date’ or any indication having the same meaning for the consumer, in the same visual field as the minimum durability date;
- the combination of these statements.

9. Consumers frequently confuse use-by dates with minimum durability dates, leading to the dumping of still consumable products and food waste. An additional indication to the minimum durability date as provided for in Regulation (EU) No 1169/2011 is therefore proposed, in order to inform more clearly that the product remains consumable once its minimum durability date has been exceeded.
This is an indication which may be voluntarily affixed by operators, pending the completion of the revision of Regulation (EU) No 1169/2011 announced on this point.
