5. Royal Decree approving the Regulation on Fire Safety in Industrial Establishments

8. The Royal Decree consists of a preamble, a sole article, two additional provisions,
six transitional provisions, one repealing provision and ten
final provisions. Subsequently inserted is the Regulation on Industrial Establishments, which consists of eighteen articles, grouped into six chapters and their annexes.
The Regulation on Fire Safety in Industrial Establishments establishes the conditions for providing an adequate level of fire safety in industrial establishments. It will repeal and replace the current Royal Decree 2267/2004 of 3 December 2004 approving the Regulation on Fire Safety in Industrial Establishments. The text also introduces amendments to Royal Decree 513/2017 of 22 May 2017 approving the Regulation on Fire Protection Installations. In addition, amendments have been made to the Basic Document DB-SI ‘Fire Safety’ of the Technical Building Code, approved by Royal Decree 314/2006 of 17 March 2006. Amendments are also made to the Order of the Ministry of Industry and Energy of 27 July 1999 determining the conditions to be met by fire extinguishers installed in vehicles for the transport of persons or goods. In addition, amendments are made to the Regulation on Safety of Refrigeration Facilities, approved by Royal Decree 552/2019 of 27 September 2019. Finally, a new provision is introduced in Royal Decree 2200/1995 of 28 December 1995 approving the Regulation on Infrastructure for Industrial Quality and Safety.
9. The main requirement that this Royal Decree aims to meet is to update the regulatory framework relating to fire protection. The purpose of the Regulation on Fire Safety in Industrial Establishments is to achieve a sufficient level of safety in the event of fire in industrial establishments and installations. To achieve this, the regulations in force to date, from 2004, establish the requirements that these establishments must meet in order to prevent the occurrence of fires, or if this is not possible, to limit their spread and make their extinction possible, minimising the damage that the fire may cause. However, in view of developments both in the technical progress and in the Community and national regulatory framework, it is appropriate to review the requirements laid down in order to prevent them from becoming outdated, while at the same time seeking to optimise and improve their content.
