In accordance with the provisions of Article 20-7 of Law No 86-1067 of 30 September 1986 on freedom of communication which transposes Article 7a of Directive 2018/1808 of the European Parliament and of the Council of 14 November 2018, the Arcom must adopt a resolution on the appropriate visibility conditions for user interfaces subject to the obligations contained in the aforesaid article.

The draft resolution aims to meet this objective. It specifies, in Articles 1 to 3, the conditions under which the appropriate visibility of services of general interest is ensured, in particular within the home pages of user interfaces, their search engines and their recommendations, while respecting the aims of proportionality, fairness and non-discrimination between actors.

This draft resolution also aims, subsidiarily, to specify the conditions pursuant to which user interface operators report the measures implemented to achieve these aims.

A note accompanying this draft resolution describes possible ways of presenting services of general interest on the pages or screens of user interfaces. It states that appropriate visibility can be ensured by an application implemented jointly by the publishers of services of general interest, and details its characteristics. This means shall comply with the requirements laid down in the draft resolution, although other arrangements are likely to meet these requirements.

9. This draft text is adopted pursuant to Article 20-7 of the Law of 30 September 1986, as referred to in paragraph 8 above.

The appropriate visibility conditions for services of general interest have been developed on the basis of the procedures specified in II of Article 20-7 of the Law of 30 September 1986 (“on the home page or screen”/“in the recommendations for users”/“in the results of searches initiated by the user”) and aim to recall the principles which must be applied: proportionality, fairness and non-discrimination between actors.

The reasons for the note accompanying the draft resolution are to facilitate understanding, by the actors, of the provisions of this draft resolution, by illustrating them though a mechanism that makes it possible to comply with them, while meeting the triple objective that the Arcom has set itself for all of its work on the subject: to facilitate the user experience, to ensure the satisfactory exposure of audiovisual group services and content and to ensure simple implementation procedures for interface operators. Other arrangements may be substituted for this mechanism.
