5. Fifth Ordinance amending the Ordinance on the application of plant protection products

6. The Ordinance concerns the application of plant protection products containing glyphosate and the application of herbicides and certain insecticides in nature reserves and flora and fauna habitat areas.

7. -

8. The purpose of the Ordinance is to lay down additional regulations for the application of plant protection products containing glyphosate.
The application thereof in arable farming should only be permitted where preventive measures or tillage are not possible or are unreasonable. Exemptions are provided for application on land vulnerable to erosion and in the case of direct drilling and mulch tillage practices. On grassland, application should only be carried out if an economical use is otherwise not possible due to high weed abundance. Application is also excluded in water and medicinal water source protection areas, core areas and buffer zones of biosphere reserves and for late pre-harvest applications.
Restrictions on the application of herbicides and certain insecticides on grassland and in forests should apply in nature reserves and areas designated as flora and fauna habitat areas.
These are insecticides which, upon registration, are declared dangerous to bees or pollinators.

9. In September 2019, the Federal Government adopted an Action Programme for Insect Protection. This provides for a set of measures to counteract the decline in the insect population and promote biodiversity. These measures include the submitted Ordinance restricting the application of certain plant protection products in areas important for nature conservation and biodiversity. The restrictions are intended to strengthen the protection of these habitats, which are important for biodiversity.
