5. Decree on the Prohibition of Certain Single-Use Plastic Food Containers made of Expanded or Extruded Plastics

The Law of 10 February 2020 on the fight against waste and on the circular economy (known as the “AGEC law”) prohibits certain single-use plastic products, including expanded polystyrene containers or receptacles for on-site or on-the-move consumption. This prohibition is intended to prevent the environmental impact of the disposal of such single-use plastic products. In order to avoid any circumvention of this prohibition, the Decree supplements it by targeting the same products when they are made partially or wholly of extruded polystyrene and expanded or extruded polypropylene.

The prohibition of expanded polystyrene containers or receptacles for on-site or on-the-move consumption provided for by the AGEC law has led to the development of alternative plastic-free solutions. However, it is observed that circumvention solutions are emerging through the implementation of different production processes which however lead to similar products (expanded polystyrene - extruded polystyrene) or through the use of plastics other than polystyrene, mainly polypropylene. In all cases, these circumvention solutions result in food containers for on-site or on-the-move consumption, all of which have the same impact on the environment due to their mode of use.

The purpose of this draft Decree is to limit the possibility of circumvention of the provisions of the AGEC law by extending the prohibition applicable to food containers made of expanded polystyrene for on-site or on-the-move consumption to those made of extruded polystyrene as well as those made of expanded or extruded polypropylene.
