8. The following measures may be technical provisions.

- Product and packaging requirements are set on electronic vaporising products without nicotine that are comparable to the requirements on electronic cigarettes with nicotine. This is based on the amendment of the Tobacco and smoking products act regulating electronic cigarettes without nicotine and further regulating herbal products for smoking. The amendment has been notified under number 2015/721/NL and published in the Bulletin of Acts and Decrees 2017, 72.

- Additional packaging requirements are set on tobacco products for smoking to prevent the packaging drawing additional attention to these products.

- When submitting notification of new or modified products and novel tobacco products, a sample of the new or modified product or novel tobacco product must also be delivered.

9. - Due to the fact that electronic vaporising products without nicotine are also harmful to health, product and packaging requirements are also set on these products to protect public health. This links up, wherever possible, with the requirements applicable to electronic cigarettes with nicotine under Directive 2014/40/EU.

- Due to the harmful nature of tobacco products for smoking, additional packaging requirements for public health protection have been set on the packaging of these products to prevent packaging features that draw additional attention to these products.

- In order to improve evaluation of new or modified products or novel tobacco products, it is now stipulated, in the interests of protecting public health, that notifications of the products shall include delivery of a sample of the new or modified product or novel tobacco product. This will facilitate product evaluation and examination for harmful effects.
