This Regulation revises the existing Regulation of the Minister for Infrastructure and Construction of 17 November 2016 on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon (Journal of Laws [Dziennik Ustaw] item 1966; 2018, item 1233 and 2019, items 1176 and 2164).
Based on experience and the assessment of the period during which the current Regulation has been in force, and following the requests submitted by national technical assessment bodies to the minister responsible for construction, land-use planning and housing, Annex 1 to the current Regulation is amended.
The terms used have been further clarified to limit doubts raised by manufacturers and thus streamline the certification process. National systems for the assessment and verification of the constancy of performance have been modified by introducing less restrictive systems for certain construction products, which will reduce the costs incurred by manufacturers. Furthermore, products have been removed from the Annex whose absence will not impact the fulfilment of basic requirements by construction works and, thus, no expenses will be incurred by the manufacturers of the removed products. Moreover, installation fixing products have been placed under one group, regardless of the type of installation and transported medium, which should also eliminate current doubts raised by manufacturers and streamline the certification process.
9. The draft Regulation implements the statutory mandate under Article 8(8) of the Act of 16 April 2004 on construction products, amended in 2015 (Journal of Laws 2020, items 215 and 471).
The provisions of the draft Regulation do not apply to products to which harmonised standards apply or to those in conformity with the European Technical Assessment issued for them, which are placed or made available on the market in accordance with Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OJ L 88, 4.4.2011, p. 5), nor to construction products placed on the market on the basis of the mutual recognition principle.
