5. Decree of the Ministry of Transport, Construction and Regional Development of the Slovak Republic establishing lists of groups of construction products and systems for assessing the performance thereof.

The draft Decree replaces the existing Decree of the Ministry of Transport, Construction and Regional Development of the Slovak Republic No 558/2009 Coll. establishing a list of construction products that must be labelled, systems of conformity attestation, and details of the use of conformity markings, as amended by Decree No 451/2011 Coll. The draft Decree contains definitions of the systems for assessing the performance of products subject to specified standards or SK technical assessments. Methods of reaction-to-fire classification are specified in the Decree in order to identify the specific system for assessing the reaction-to-fire performance. Annex No 1 to the draft Decree is a list of construction product groups involving the obligation of manufacturers, importers or distributors to issue SK performance declarations under the new Act on Construction Products (Notification No 2012/0543/SK). If a harmonised standard or a European assessment document applies to the product, the procedure in accordance with the relevant European Parliament and Council Regulation ((EU) No 305/2011 on construction products will be followed. Annex No 2 to the draft Decree is a sample form of the SK declaration of performance, issued on the basis of performance assessment according to the specified (Slovak) standard or SK technical assessment.

Based on Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products, the existing Act No 90/1998 Coll. on construction products will be replaced by a new Act on construction products (Notification No 2012/0543/SK), which shall enter into force on 1 July 2013. Its derogatory provisions will abolish the existing Decree of the Ministry of Transport, Construction and Regional Development of the Slovak Republic No 558/2009 Coll., as amended by Decree No. 451/2011 Coll., and a new Decree will be adopted on the basis of the Act’s empowering provisions.
