5. Draft implementing decree on tobacco labels

8. The draft implementing legislation replaces Implementing Decree No 467/2003 on the use of tobacco labels to mark tobacco products, as amended. The subject matter of the legislative proposal is a modification of the existing technical and operational aspects of labelling tobacco products using a tobacco label. This concerns, in particular, how the tobacco label is placed on unit packets. Given that on 19 May 2019 the transitional period during which the tobacco label may be placed above the combined health warning on the top edge of the back surface of hard unit packets of cigarettes will expire, it will no longer be possible to use the tobacco label in the established manner. For this reason, with a view to providing room for the tobacco label, the requirement that the tobacco label must be damaged when the unit packet is opened is being waived and it is proposed that the technical parameters of the tobacco label be modified, i.e. by changing its dimensions and design. The draft also concerns the details of how tobacco labels are ordered (model form for ordering tobacco labels) and collected, details of record-keeping (model form for record-keeping of tobacco labels), tobacco label inventories and how damaged tobacco labels are returned.

The draft legislation is the result of an adopted amendment to Act No 110/1997 on foodstuffs and tobacco products and on amendments to certain related acts, as amended, and Implementing Decree No 261/2016 on tobacco products. Following the adoption of this legislation, certain aspects of the labelling and packaging of tobacco products, including the health warnings which must be provided on unit packets of tobacco products and any outside packaging are being modified. For these reasons, it was necessary to modify the technical parameters of the tobacco label placed on unit packets of tobacco products. At the same time, the proposed model tobacco label complies with the technical requirements set out by Commission Implementing Decision C(2017)8435 final on technical standards for security features applied to tobacco products. On the basis of § 114 of Act No 353/2003 on excise duties, as amended, the tobacco label is a tax stamp since the value of the tobacco label corresponds to the amount of tax liabilities applicable to the given unit packet of the tobacco product.
