5. Regulation of the Federal Minister of Labour, Social Affairs and Consumer Protection on the placing on the market of airsoft weapons and paintball markers (2012 Airsoft Weapons Regulation)

With these regulations on the basis of the 2004 Product Safety Act, Federal Law Gazette I 16/2005 (implementing the General Product Safety Directive 2001/95/EC), the sale and distribution of airsoft weapons and paintball markers, insofar as they are not subject to weapons legislation and are not toys, are subject to the following requirements:
- Distribution to persons under the age of 18 is not permitted. The age of the purchaser must also be checked in the case of distance selling.
- Distribution at street markets, market-like events and in self-service is prohibited.
- In sales premises (excluding authorised arms dealers) the products must be stored separately.
9. The reason behind the regulation is the increasing number of incidents where uninvolved people are fired at.
The purpose of the regulation is to prevent the misuse of these products by young people.

15. No significant economic effect, because the distribution restrictions on airsoft weapons and paintball markers relate only to a specific age group (under 18); however, it may lead to lower revenues. The relevant products may therefore continue to be placed on the market.
On the other hand, the extent of the misuse of airsoft weapons should decrease.
