The Government Decree contains detailed rules on activities related to preventing the production of biodegradable waste, waste management activities related to biodegradable waste, and the classification of compost produced from bio-waste. In particular, it regulates in detail the provisions on biodegradable waste collection, the separate collection of green waste, site composting, stabilisation, and biogas production.

In accordance with the principle of recovery concerning biodegradable waste under Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives, it is necessary to facilitate the separate collection and recovery of biodegradable waste so as to return the possibly highest purity material to the natural organic material cycle after recovery, and to reduce the biodegradable content of municipal waste disposed at landfill sites.

Directive (EU) 2018/851 of the European Parliament and of the Council of 30 May 2018 amending Directive 2008/98/EC on waste requires Member States to take specific measures to prioritise prevention, re-use and recycling vis-a-vis landfilling and incineration, including measures related to biodegradable and bio-waste.

The purpose of the draft is to implement the national transposition of the obligations imposed by the above Directives.

The notification under Article 6(4) of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives, as well as Directive (EU) 2018/851 of the European Parliament and of the Council of 30 May 2018 amending Directive 2008/98/EC on waste is also a notification in accordance with point 7 of this information sheet.
