5. Regulation amending the Vehicles Regulation [Regeling voertuigen] in connection with the improvement of certain imperfections regarding special mopeds
6. Products, namely special mopeds. These are electric vehicles with a maximum power of 4 kW and a maximum speed not exceeding 25 km/h, for which no European type-approval is required.

8. Since 1 January 2024, the placing on the market and use of special mopeds in the Netherlands has been subject to a national type-approval requirement. Special mopeds are motor vehicles with a maximum design speed not exceeding 25 km/h, equipped with an electric motor with a maximum continuous rated power not exceeding 4 kW, other than a disabled vehicle, which does not require type-approval in accordance with rules established within the framework of the European Union. Until 1 January 2024, a designation was mandatory. It was envisaged that the requirements for approval and use before and after 1 January 2024 would be the same. Due to a number of imperfections, differences have nevertheless occurred compared to the situation until 1 January 2024. This Regulation eliminates these differences.
This concerns the method of calculating the force that belt anchorages must be able to withstand. That force must be calculated in accordance with UNECE Regulation No 14. Furthermore, it has been made possible to place seats in directions other than forward-facing. This Regulation also provides that a special moped must be re-approved if it is modified in such a way as to affect its resistance to electromagnetic radiation or the amount of radiation emitted by the vehicle. These requirements were already in force until 1 January 2024, but were erroneously dropped.
9. The quality of belt anchorages and resistance to electromagnetic radiation are important for the quality of a special moped. The requirements are therefore necessary to ensure the quality of special mopeds. Under the current rules, it is not possible to have a seat in a special moped that is not forward-facing. That restriction shall be repealed.
The selected tractive force that a belt anchorage must be able to withstand is taken from the applicable UNECE requirements, which apply to other vehicles. When assessing the impact of electromagnetic radiation, compliance with existing standards that are already applicable when applying for approval is verified. This does not therefore introduce any new requirements, but merely requires reassessing whether the vehicle still complies with the requirements already in force after the modification. In view of the above, the chosen requirements are proportionate and the least restrictive alternative has been chosen.
The same requirements apply to all special mopeds, regardless of where the vehicle is produced. Therefore, mutual recognition is not necessary. These requirements also contain no elements that favour vehicles produced in the Netherlands. Therefore, the measures are not discriminatory.
