8. Amendment to the Commodities Act Decree on herbal preparations
A ban on certain plants is now added to the Annex to the Commodities Act Decree on herbal preparations [Warenwetbesluit Kruidenpreparaten]. A ban on harmful substances from plants and fungi in herbal preparations is also added to the Commodities Act Decree on herbal preparations.

Amendment to the Commodities Act Decree on administrative penalties
The Annex to the Commodities Act Decree on administrative penalties [Warenwetbesluit bestuurlijke boeten] is amended so that the breach of the new provisions of the Commodities Act Decree on herbal preparations can be punished with an administrative penalty.

The main reasons for amending the Commodities Act Decree on herbal preparations is to better protect consumers from products that may be harmful to health and improve the enforceability of the Decree. The Commodities Act Decree on herbal preparations lays down requirements for herbal preparations to protect public health. The Annex to the Commodities Act Decree lists plants that are to be deemed toxic in all cases. Several plants are now added to this annex due to some risk assessments by the Dutch National Institute for Public Health and the Environment [RIVM] and the Office for Risk Assessment & Research of the Netherlands Food and Consumer Product Safety Authority [NVWA].

Article 13d of the Commodities Act contains a mutual recognition clause. The mutual recognition principle entails that an EU Member State shall not ban the sale of goods that have been legally brought onto the market in another EU Member State in its own territory on the grounds that the goods do not meet its own national regulations. It is pivotal that goods from another EU Member State offer at least an equivalent level of protection. Thus, trade in goods with an equivalent level of protection originating from other EU Member States falling under the scope of this Decree shall not be prohibited by virtue of the requirements set out in this Decree.

The requirements on goods set out in this Decree are justified in the interests of protecting consumers from products that do not meet the quality standards to which they are accustomed.
