5. Amendments to the Tobacco Control Act and the labelling regulations (standardised packaging and flavour ban for e-cigarettes and minimum size for snus)

8. The following measures are proposed to hinder the uptake of e-cigarettes and snus among children and young people:
1) Standardised packaging for e-cigarettes and refill containers, regardless of nicotine content, cf. draft amendments to the Tobacco Control Act § 30.
2) Ban on characterising flavours in e-cigarettes and refill containers, regardless of nicotine content, cf. the proposed new provision in the Tobacco Control Act § 32a. The ban will also apply to separate containers of flavour additives, and equipment and components used in connection with e-cigarettes. The Ministry may in regulations adopt a list of which flavour additives are permissable to use as ingredients in e-cigarettes and refill containers.
3) A requirement for snus packages to include at least 20 portions and 15 kilograms, or 30 kilograms of loose snus, cf. draft amendments to the labelling regulations § 31.
9. Tobacco use is the main preventable source of disease and mortality in Norway, and also the main single cause of social health inequalities. The Norwegian Tobacco Control Act has as its objective to contribute to a tobacco-free society.
Norway currently has a ban on e-cigarettes and refill containers with nicotine. As an EFTA State, Norway has not yet implemented the Tobacco Products Directive 2014/40/EU (the TPD), but this is expected to happen shortly. E-cigarettes and refill containers with nicotine will then enter the Norwegian market.
The Norwegian government is currently working on a new national tobacco control strategy, where the protection of children and young people from the harms of tobacco and nicotine addiction will be a priority. As part of this work, the Norwegian Ministry of Health is proposing to introduce standardised packaging and a flavour ban for e-cigarettes and refill containers, in order to make them less attractive for children and young people. In addition, a minimum size and weight limit for snus is proposed, based on similar legislation in Sweden. This regulation is meant to make snus less accessible for children and young people.
