8. 1. The sale of food products and non-alcoholic beverages, except tonics, water, juices, non-alcoholic ciders and non-alcoholic beers, is not permitted at a point of sale specialising in the retail sale of alcoholic beverages.
The new version of the Regulation prohibits the sale of goods targeted at minors in the range of products of a store specialising in the retail sale of alcoholic beverages.
2. The retail sale of spirits is not permitted at a filling station store or a store located in the vicinity of a filling station if the distance between the entry to the store and the closest filling pump is less than 15 m.
The currently effective provision prohibits the sale of spirits at filling station stores. It is intended to also retain this restriction in the new version.
9. 1. At the end of 2019, it was established that up to 5 % of the range of products (in certain cases up to 10 %) of stores specialising in the retail sale of alcoholic beverages in Tallinn are targeted at minors. Such food products are above all ice creams, lemonades, biscuits, potato chips, lollipops, etc. Therefore, minors also visit stores specialising in the retail sale of alcoholic beverages - mainly schoolchildren and young people and also without accompanying adults. The remaining range of goods at such a store mainly consists of alcoholic beverages, and to a lesser extent, also tobacco products and goods related thereto. Such stores do not sell conventional food products (such as bread, milk or butter). The sale of food products and non-alcoholic beverages targeted at minors at such stores does not comply with the predominant societal values and attitudes. The aim of the restriction is to reduce the exposure of young people to alcoholic beverages and their contact with persons who have consumed alcohol or have a hangover.
2. According to a survey conducted in the city of Tallinn in 2015, from among alcoholic beverages, men particularly prefer spirits in addition to beer. This restriction will make it possible to limit the availability of alcohol and spread the understanding that alcohol consumption and driving are incompatible. Prohibiting both alcopops and spirits in filling station stores located in Tallinn would have been a more intense restriction of a fundamental right. The city of Tallinn does not exclude this option for the future, but considering the proportion of spirit consumption and the fact that spirits affect the body at a much faster rate than alcopops, the sale of spirits was prohibited in filling station stores. This restriction was not very intense by nature and did not cause the closing of filling station stores, which is evidenced by the fact that more filling station stores have been built in Tallinn after imposing the restriction (e.g. the Olerex filling station chain in 2014 - 8, in 2020 - 16, Alexela filling station chain in 2014 - 2, in 2020 - 5).
